Drug Crime Enhancements Lawyer In Orange, TX
An enhancement does not change what you are accused of doing. It changes the punishment range attached to it. In a Texas drug case, the location, a weapon, a prior record or the involvement of others can each move a charge up a full level, and this page explains how each one works and what the state must prove.
What Is A Drug Crime Enhancement In Texas?
A drug enhancement is a fact the state alleges that raises the punishment range of a drug offense. Texas uses drug-free zones under Health and Safety Code § 481.134, deadly weapon findings, prior felony convictions under Penal Code §§ 12.42 and 12.425, and organized criminal activity under § 71.02. Each must be pleaded and proven.

Understanding Texas Law
How Do Drug-Free Zones Raise A Texas Drug Charge?
Health and Safety Code § 481.134 is the enhancement written specifically for drug cases. It raises the punishment for drug offenses committed in, on or near places the Legislature chose to protect.
The distances are measured from the premises, which can include grounds and property lines rather than just a building. A radius of 1,000 feet covers a wide area in a residential neighborhood. Section 481.135 allows maps produced by a local government to be used as evidence of where those boundaries lie.
The places § 481.134 covers:
- Within 1,000 feet of premises owned, rented or leased by a school or school board
- Within 1,000 feet of the premises of a youth center or of a playground
- Within 300 feet of a public swimming pool or a video arcade facility
- In or on a school bus
A person convicted of a zone-enhanced offense who has a prior zone-enhanced conviction is not eligible for community supervision under Code of Criminal Procedure Chapter 42A.
The zone is a fact about where the offense happened. The state must prove the place qualifies and that the distance is within the limit.
Penalties And Consequences
What Do Drug Enhancements Add To The Penalties In Texas?
Each enhancement has its own statute, its own proof requirements and its own effect on the range. Several can apply to one case at the same time. These are statutory rules, not predictions for any one case.

Or life, for most felony-level charges.

Possible Defenses
How Can A Drug Enhancement Be Challenged?
An enhancement is not automatic because it appears in the indictment. A prior conviction has to be proven final and linked to the accused through judgments, fingerprints or other records. A zone allegation needs a measured distance to qualifying premises. A deadly weapon finding requires proof that a weapon was used or exhibited during the offense or the flight from it, not just that one was somewhere in the house.
Weapons can also bring separate charges. Carrying a handgun while engaged in criminal activity is covered on the unlawful carrying of a weapon page, and federal law adds separate firearm offenses tied to drug trafficking.
Why enhancements reach past the sentence.
A deadly weapon finding makes an offense one of the 3g offenses, which affects both probation eligibility and parole timing. Prior-conviction enhancements can turn a case that would have been probation-eligible into one with a prison minimum.
Group activity is handled differently again. When three or more people collaborate, the state can charge engaging in organized criminal activity, covered on the drug conspiracy page.

What Happens After An Enhanced Drug Arrest In Orange County?
An enhancement does not change the path through the courts. It changes the range the court and the prosecutor are working within.
Arrest And Charging
The arrest is made on the underlying drug offense. The enhancement may appear in the charging paper or in a separate notice.
Records And Measurements
The state gathers prior judgments, premises maps or measurements, and any weapon evidence. The defense can request these under Code of Criminal Procedure art. 39.14.
Motions
The defense can challenge the search, the lab results and the proof of the enhancement before trial.
Plea Or Trial
An enhancement is proven at trial or at sentencing, and it can also be removed or dropped as part of a plea agreement.

What Should You Do After A Drug Enhancement Is Alleged?

Look for any enhancement language, including a zone, a weapon or a prior conviction.
List Your Prior Cases
Write down every earlier case, its court, date and result, even old ones.
Note The Location
Write down the address and what stands nearby, such as a school, park or pool.
Account For Any Weapon
Tell your lawyer where any firearm was and who owned it.
Do Not Plead Early
An early plea may accept an enhancement the state could not prove.

Common Questions
Drug Enhancement Questions People In Orange Ask
What is a drug-free zone in Orange, TX?
Health and Safety Code § 481.134 defines drug-free zones as places within 1,000 feet of school premises, a youth center or a playground, within 300 feet of a public swimming pool or video arcade facility, and on a school bus. A drug offense committed in one of those areas carries a higher punishment than the same offense elsewhere.
How much does a drug-free zone raise a charge in Orange County?
The effect depends on the underlying offense. Under § 481.134, a state jail felony drug offense in a zone becomes a third degree felony, many higher felony offenses are punished at the next degree up, top-tier delivery offenses carry a minimum term increased by five years and a doubled maximum fine, and some misdemeanor drug offenses are raised as well.
How do prior convictions enhance a drug charge in Orange, TX?
Penal Code § 12.42 raises the punishment level when the state proves a prior felony conviction. A third degree felony becomes second degree, a second degree becomes first degree, and a first degree carries 15 to 99 years or life. With two prior sequential felony convictions, most felonies carry 25 to 99 years or life. State jail felonies have their own rules under § 12.425.
Does having a gun during a drug offense in Orange County make it worse?
A deadly weapon finding raises a state jail felony to a third degree felony under Penal Code § 12.35(c) and removes the judge's power to grant regular community supervision under Article 42A.054. Carrying a handgun while engaged in criminal activity can also be charged separately, and federal law has its own firearm offenses tied to drug trafficking.
Does the state have to prove an enhancement in an Orange, TX drug case?
An enhancement has to be pleaded and proven like any other fact that raises the range. For a prior conviction, the state must prove the conviction exists, that it was final, and that it belongs to the accused. For a drug-free zone, it must prove the location and distance. A defendant can contest each of those facts at trial or at sentencing.
Can fentanyl delivery that leads to a death be charged as murder in Orange, TX?
Since 2023, Texas law allows a murder charge under Penal Code § 19.02 when a person knowingly manufactures or delivers a Penalty Group 1-B substance and someone dies after taking it. That is a charge in its own right, not a sentence enhancement, and the state must prove the substance, the delivery and the link to the death.
