How Are Internet Drug Crimes Charged In Texas?

Texas has no single internet drug crime. Online purchases and sales are charged under the Controlled Substances Act, Health and Safety Code Chapter 481, as possession, delivery or conspiracy. Federal law adds offenses for internet distribution and for using the mail to commit a drug felony. The same shipment can support a state case, a federal case, or both.

Understanding Texas Law

How Are Online And Mail-Order Drug Cases Charged In Texas?

There is no single Texas offense called an internet drug crime. The conduct is charged under the ordinary drug statutes, and the internet part becomes evidence. Receiving pills ordered from an overseas site is possession. Selling through a messaging app is delivery. Arranging shipments with others can be conspiracy.

What changes is who investigates and which court takes the case. A package crossing state or national lines, a payment in cryptocurrency, or a sale through a dark web marketplace brings in federal agencies. The federal statutes reach conduct that Texas law covers only indirectly, including internet distribution without a valid prescription and use of the mail to facilitate a drug felony.

Conduct that can bring an online drug charge:

  • Ordering controlled substances from a website or marketplace without a valid prescription
  • Buying counterfeit pills sold as prescription medication
  • Advertising or offering drugs for sale on social media or messaging apps
  • Shipping or receiving drugs through the mail or a private carrier

Counterfeit pills matter for charging. A pill sold as oxycodone that tests as fentanyl is charged under Penalty Group 1-B, and the weight counted is the whole pill, filler included.

For a possession charge the state still has to prove the person knew what was in the package and exercised control over it.

Penalties And Consequences

What Are The Penalties For Internet Drug Crimes?

A case filed in Orange County uses the Texas penalty groups and weight tiers. A federal case uses federal statutes and the Sentencing Guidelines. The same shipment can support either, and in some cases both. These are statutory descriptions, not predictions.

State possession or delivery
Graded by penalty group and aggregate weight under Health and Safety Code Chapter 481. The tiers are on the penalty groups page.
Offer to sell online
Charged as delivery in Texas, with corroboration required under § 481.183.
Internet distribution, federal
21 U.S.C. § 841(h) prohibits delivering, distributing or dispensing controlled substances by means of the internet except as the Controlled Substances Act authorizes.
Use of the mail, federal
21 U.S.C. § 843(b) makes it a separate felony to use a communication facility, including the mail, to commit or facilitate a drug felony.

Federal drug sentencing works differently from Texas ranges, with mandatory minimums tied to drug quantity.

Real Questions

What Do People Ask About Internet Drug Crimes In Texas?

What if a package came to my address and I did not order it?

An address on a label is not proof of knowledge. For example, suppose a package is addressed to a former roommate and left on a porch. The state would still have to show the person who opened it knew what was inside and controlled it. This is an example, not a real case.

Does paying in cryptocurrency make a case harder to prove?

Cryptocurrency can leave a public record of transfers, and exchanges keep account information. Linking a wallet address to a person takes evidence, such as exchange records or device data. Each link can be tested for accuracy and for how it was obtained.

Can I be charged for what I only posted or messaged?

An offer to sell is part of the Texas definition of delivery. The state has to corroborate the offer under § 481.183, and it has to show who actually controlled the account that posted or sent it.

Will it be a state or a federal case?

Neither is certain from the arrest alone. Local officers can start a state case. Federal agencies investigate packages in the mail and online markets, and a federal case can follow or run beside a state one. Which one files first changes the courts and the range.

Possible Defenses

How Can An Internet Drug Charge Be Defended?

Online cases are built from accounts, not hands. A username, an email address, a shipping label and a wallet address each have to be connected to the accused with evidence, and shared devices, shared addresses and reused names all break those links.

Searches of phones and online accounts generally require a warrant. The Supreme Court held in Riley v. California that police need a warrant to search the digital contents of a phone seized at arrest, and in Carpenter v. United States that historical cell-site location records generally require one too. A search of a package in the mail stream also has its own warrant rules.

Questions an online case raises:

  • Who actually controlled the account that placed the order or made the offer
  • Whether the name or address on a package proves knowledge of its contents
  • How the package was opened, and under what authority
  • Whether phone and account data was obtained with a valid warrant

Some online cases involve prescription medications. When the charge is built on forged or misused prescriptions, the drug diversion page covers the statute used.

Wiping a phone or an account can be charged separately and looks worse than the data.

If a package you did not order arrives, ask a lawyer before opening or moving it.

Note Who Shares Your Devices

Tell your lawyer who used your phone, computer and address.

Save The Paperwork

Keep any warrant copy, receipts and notices from agents.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Orange trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Internet Drug Crime Questions People In Orange Ask

Is it a crime to order drugs online and have them shipped to Orange, TX?

Receiving a controlled substance without a valid prescription is possession under the Texas Controlled Substances Act, regardless of how it arrived. Federal law separately prohibits distributing or dispensing controlled substances by means of the internet without a valid prescription, and importing them from outside the country. A package addressed to a person is evidence, but the state still has to prove that person knew what was inside.

What is the Ryan Haight Act and does it apply in Orange County?

The Ryan Haight Online Pharmacy Consumer Protection Act of 2008 is federal law and applies everywhere in the country. It amended the Controlled Substances Act to require, subject to exceptions including certain telemedicine rules, a valid prescription based on at least one in-person medical evaluation before a controlled substance is dispensed through the internet, and it regulates online pharmacies.

Is offering to sell drugs on social media a crime in Orange, TX?

Texas defines delivery of a controlled substance to include an offer to sell, so a posted or messaged offer can support a delivery charge even with no drugs exchanged. Health and Safety Code § 481.183 requires the offer to be corroborated. When the offer is in writing, such as a message, the corroboration has to come from evidence other than the written offer itself.

Can a dark web drug purchase in Orange County be prosecuted federally?

Dark web markets, cryptocurrency payments and mailed packages all involve federal jurisdiction, and federal agencies including the Postal Inspection Service and the DEA investigate them. Federal charges can include possession with intent to distribute under 21 U.S.C. § 841 and using a communication facility such as the mail to commit a drug felony under 21 U.S.C. § 843(b).

What is a controlled delivery in an Orange, TX drug case?

A controlled delivery is an investigative technique in which officers who have found a controlled substance in a package allow it to be delivered under surveillance, then arrest whoever accepts or opens it. The evidence it produces goes to possession and knowledge, and the legality of the package search, any warrant, and the handling of the parcel can all be challenged.

Can police search my phone after an online drug arrest in Orange, TX?

The Supreme Court held in Riley v. California that police generally need a warrant to search the digital contents of a phone seized at arrest. Historical cell-site location records also generally require a warrant under Carpenter v. United States. Exceptions exist, so whether a given phone search was lawful is a fact-specific question for a motion to suppress.
