College Student DWI Lawyer In Orange, TX

A DWI arrest in college lands before a degree, before a first job and often before age 21, and the criminal case, the license case and the school's own process can run at the same time. This page explains which charge applies by age, what the school can do and how the record affects what comes next.

You have 15 days. A DWI arrest starts an ALR case against your license. The request for a hearing is due within 15 days of receiving the notice of suspension, whether or not school is in session.

What Happens When A College Student Is Charged With DWI In Texas?

A college student charged with DWI faces a criminal case under Penal Code § 49.04, an ALR license case, and often a school conduct review. A student under 21 with any detectable alcohol can be charged with DUI by a minor under Alcoholic Beverage Code § 106.041, a Class C misdemeanor, or with DWI when the result is 0.08 or higher or faculties are lost.

Understanding Texas Law

How Does Texas Law Treat A College Student's DWI?

A DWI arrest for a college student starts the two cases every DWI starts: a criminal case under Penal Code § 49.04, and an administrative license case through the ALR process. For many students it also starts a third, a conduct review under the school's student code.

The criminal case is prosecuted by the Orange County District and County Attorney's Office. The license case is heard by the State Office of Administrative Hearings, and a hearing has to be requested within 15 days of receiving the notice of suspension.

Texas public universities and colleges each publish a student code of conduct. Many of those codes apply to conduct off campus as well as on it, and many address alcohol offenses and criminal charges specifically. Students at Lamar University in Beaumont and at Lamar State College Orange are subject to their own institution's code.

A school conduct process is not a court. It uses its own procedures and its own standard of proof, and it can move faster or slower than the criminal case.

Where a student DWI can have effects:

  • The criminal record, which background checks for jobs and graduate programs can reach
  • The driver's license and the ability to get to class or work
  • Student conduct standing at the school
  • Scholarships, athletics and programs with their own conduct terms
  • Professional licensing for fields like nursing, teaching and law

Students heading toward licensed professions can read about how boards view DWI on the DWI defense for licensed professionals page.

Penalties And Consequences

What Are The Penalties For A College Student's DWI In Texas?

Age decides which statute applies. A student 21 or older is charged the same as any adult. A student under 21 can be charged under the Alcoholic Beverage Code or the Penal Code, depending on the evidence. These are statutory limits, not predictions.

Jail range for a first DWI, age 21 and over

Fine of up to $2,000.

Class C
DUI by a minor, any detectable alcohol

Under Alcoholic Beverage Code § 106.041.

20 to 40 hours
Community service for a first minor DUI

1 year
DPS suspension for a minor convicted of DWI

DPS lists 18 months for later offenses.

Driving under the influence by a minor, Alcoholic Beverage Code § 106.041. A Class C misdemeanor on a first offense, with court ordered community service in addition to any fine.
Under 21, 0.08 or loss of faculties
Can be charged as DWI under the Penal Code, with the full adult penalty range.
Ignition interlock
When a judge orders community supervision for a defendant who was under 21 at the time of the offense, the statute directs the judge to require an ignition interlock device (article 42A.408).

Real Questions

What Do People Ask About A College Student DWI In Texas?

Does a student under 21 face different ALR rules?

Yes, in a few ways. At the ALR hearing, the issue for a driver under 21 is any detectable amount of alcohol instead of the adult level. Before asking for a specimen, the officer's warning tells a driver under 21 that a suspension of at least 60 days can follow a detectable result, even when the person agrees to the test. The 15 day request window is the same.

Can the school act before my criminal case ends?

The school's process is separate, and each code sets its own timeline. A school may hold its conduct review while the criminal case is still open. Statements made in a school hearing are not protected by the rules that govern a criminal courtroom, and they can be sought for use in the criminal case. A student who has been notified of a hearing can ask a lawyer how to handle that overlap.

What does a stop look like for a student under 21?

For example, a 20 year old leaves an off campus gathering and is stopped for a headlight issue. The officer smells alcohol and the breath result is 0.05. That result is below the adult level, so a DWI charge would depend on proof of lost faculties, but it can support a Class C charge for a minor with any detectable alcohol. This is an example, not a real case.

Do I have to tell my school or program about an arrest?

It depends on the rule. Some student codes, scholarship agreements, athletic departments and clinical programs require students to report arrests, and some set the deadline. The published code or the signed agreement controls. A student who is unsure can read the conduct code and the program handbook before deciding what to send.

Possible Defenses

How Can A College Student's DWI Be Defended?

A student's DWI file is built the same way as any other, from the stop, the officer's observations and the chemical test. An attorney reviews each piece to see what the state can prove, and also checks which statute was charged, because an under 21 case can be filed in more than one way. No result can be promised.

The age of the student can also change what a resolution looks like, so the outcome is read against the school code and any program terms, not only the court judgment.

The record follows the resume.

Graduate and professional school applications ask about criminal history. So do employers, licensing boards and the military. A DWI conviction in Texas is permanent, and Texas has no lookback limit for using a prior DWI to enhance a later one.

Whether a case can later be cleared depends on how it ends. A dismissal or acquittal can open the door to an expunction. Some DWI resolutions can qualify for an order of nondisclosure, which seals the record from most public background checks, under conditions set out in the Government Code.

Your Attorney

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Orange trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

College Student DWI Questions People In Orange Ask

Can a college suspend a student for a DWI arrest in Orange, TX?

Texas public universities and colleges each adopt a student code of conduct, and many of those codes reach off campus conduct, including alcohol and criminal offenses. The school's process is separate from the criminal case, uses its own standard of proof, and runs on its own timeline. The specific rules are set out in each school's published code.

What charges can a college student under 21 face after a DWI stop in Orange County?

A student under 21 who has any detectable alcohol while driving can be charged with driving under the influence by a minor under Alcoholic Beverage Code § 106.041. With a 0.08 result or evidence of lost faculties, the charge can be DWI under Penal Code § 49.04 instead. A fake ID or open container found during the stop can add separate charges.

Does a DWI in Orange, TX affect student financial aid?

Federal student aid eligibility is not tied to a DWI conviction. Private scholarships, athletic programs and some institutional awards set their own conduct conditions, and those vary widely. The terms of each scholarship or program agreement control whether an arrest or conviction has to be reported.

Can a college student DWI in Orange County be removed from the record?

Texas allows expunction when a case ends in dismissal, acquittal or certain other dispositions, and it allows an order of nondisclosure for some DWI resolutions that meet the conditions in the Government Code. A conviction itself stays on the record. Which relief exists in a given case depends on how that case ends.

Will my college tell my parents about a DWI arrest in Orange, TX?

Federal privacy law, FERPA, allows a college to tell a parent when it finds that a student under 21 committed an alcohol or drug violation under its own rules. The law permits this but does not require it, and a state law that bars the disclosure still applies. A school's own policy and the student's status as a dependent can also matter.

What happens to an international student charged with DWI in Orange, TX?

A criminal arrest or conviction can matter to a student visa holder beyond the Texas penalties. Federal immigration authorities and the State Department can consider alcohol related driving offenses in visa decisions. Those questions are governed by federal immigration law rather than the Texas Penal Code, and they turn on the specific visa category and the final disposition of the case.
