Police officer handcuffing a person beside a vehicle, the kind of arrest that can follow a BWI stop

Boating While Intoxicated Lawyer In Orange, TX

Boating while intoxicated is charged under the same chapter of the Penal Code as a DWI and carries the same first offense range, and a game warden rather than a patrol officer often makes the arrest. This page covers what the state must prove on the water, the penalties, the license case that can follow and how BWI cases are defended.

Your driver's license is at risk too. A failed or refused breath or blood test after a BWI arrest can start the same license suspension process as a DWI. The window to request an ALR hearing is 15 days after you receive the notice.

What Is Boating While Intoxicated In Texas?

Boating while intoxicated is operating a watercraft while intoxicated, an offense under Texas Penal Code § 49.06. Intoxicated means an alcohol concentration of 0.08 or higher, or not having the normal use of mental or physical faculties because of alcohol, a drug or another substance. A first offense is a Class B misdemeanor with a 72 hour minimum jail term, and the statute does not require a public place.

Understanding Texas Law

How Does Texas Law Define Boating While Intoxicated?

Texas Penal Code § 49.06 makes it an offense to be intoxicated while operating a watercraft. "Intoxicated" has the same meaning it has for a DWI under § 49.01: an alcohol concentration of 0.08 or more, or not having the normal use of mental or physical faculties because of alcohol, drugs or a combination.

Unlike a DWI, the BWI statute does not mention a public place. What it requires is operation of a watercraft. Section 49.01 defines a watercraft as a vessel, one or more water skis, an aquaplane, or another device used to carry a person on water, other than a device moved only by the current. A fishing boat, a ski boat and a personal watercraft all fall inside that definition.

Being on a boat with a drink is not a crime. The charge applies to the person operating the craft, and "operating" is an element the state has to prove along with intoxication.

What the state has to prove in a BWI case:

  • The person was operating a watercraft
  • The operation took place in Orange County
  • The person was intoxicated, by a 0.08 or higher concentration or loss of normal faculties

Section 49.061, added effective September 1, 2023, creates a separate offense for operating a watercraft while intoxicated with a passenger younger than 15. It is a state jail felony.

When someone is hurt or killed, the charge can become intoxication assault or intoxication manslaughter. Both statutes cover watercraft as well as motor vehicles.

Penalties And Consequences

What Are The Penalties For Boating While Intoxicated In Texas?

The penalty structure for BWI mirrors the one for DWI, and the same enhancement rules apply across both. These are the limits the statutes allow, and they do not predict what will happen in a given case.

72 hrs to 180 days
Jail range for a first BWI
$2,000
Maximum fine for a first BWI

Plus court costs.

30 days
Minimum jail with one prior

The offense becomes a Class A misdemeanor.

State jail felony
BWI with a passenger under 15

Charged under § 49.061.

Classification
Class B misdemeanor (§ 49.06).
Jail
72 hours minimum, up to 180 days.
Fine
Up to $2,000, plus court costs.
With one prior intoxication conviction
Class A misdemeanor, 30 day minimum (§ 49.09(a)).
With two priors
Third degree felony (§ 49.09(b)). Prior DWI, BWI and flying while intoxicated convictions all count.
With a passenger under 15
State jail felony (§ 49.061).
Probation
Community supervision can be ordered in place of some or all of the jail time. Deferred adjudication is not available when the person held a commercial license or the result was 0.15 or higher, and a judge who grants it has to require an ignition interlock unless an evaluation shows it is not needed.
Driver's license
A test failure or refusal after a BWI arrest can start the ALR process, with the 15 day window to request a hearing before the State Office of Administrative Hearings.

A second intoxication offense of any kind changes the case, because Penal Code § 49.09 counts a BWI the same as a DWI and sets no lookback period. That is one reason a first BWI deserves a careful review.

Real Questions

What Do People Ask About Boating While Intoxicated In Texas?

Can I be charged if the boat was anchored or the engine was off?

It depends on the facts. Suppose a person is asleep on a boat anchored in a cove with the motor off, and another person is at the helm of a drifting boat with the engine running. The first scenario raises a question about whether anyone was operating the craft, and the second raises it far less. Courts look at control of the vessel, its location and the other evidence. This is an example, not a real case.

Will I have to give a breath or blood sample on a boat?

Texas implied consent law covers watercraft, so a person arrested for BWI is deemed to have consented to a breath or blood specimen, subject to chapter 724. An officer generally needs a warrant or probable cause of exigent circumstances to require one. The statute also lists situations where an officer shall require a specimen after a refusal, including a collision with injury and a passenger under 15.

Does the refusal hearing treat every boat the same?

Not necessarily. The statute that lists the issues at a refusal hearing, Transportation Code § 724.042, refers to a watercraft powered by an engine rated at 50 horsepower or more. Whether that wording matters in a given case depends on the boat and the facts, and it is one of the questions a lawyer checks in the file.

Does a BWI show up on my driving record or background check?

A conviction is a public criminal record that employers, landlords and licensing boards can find. A BWI also counts as a prior intoxication offense for later cases. A case that ends in dismissal or acquittal can often be expunged, and the expunction page explains the general rules.

Possible Defenses

How Can A Boating While Intoxicated Charge Be Defended?

A BWI case is built from the contact on the water, the officer's observations and the chemical test. An attorney reviews each piece to see what the state can prove. No result can be promised.

The first question is often whether the person was operating the watercraft at all, since the statute reaches the operator and not every passenger. The second is whether the evidence of intoxication was gathered fairly, given how different a boat is from a roadside.

The conditions on the water are part of the evidence.

A BWI stop can begin with a safety equipment check, a registration check or a navigation light stop, and the questioning often happens on a moving deck or at a dock. After hours of sun, wind, heat and motion, balance tests are harder for anyone to perform.

Video from a patrol boat or a body camera can show where the tests were given, how long after leaving the water, and what the footing looked like.

Next Steps

What Should You Do After A Boating While Intoxicated Arrest?

A BWI starts a criminal case and, in many cases, a license case at the same time. These steps are general information, not advice for any one person.

Count 15 Days

Find the date on the notice of suspension and count 15 days from receiving it.

Keep The Paperwork

Keep the citation, the notice, the bond papers and any test paperwork.

Note Who Was Operating

Write down who was at the helm, where the boat was and how long it had been running or anchored.

Record The Conditions

Note the weather, the water, the footing where tests were given and how long you were on the water.

Save Photos And Video

Keep photos or video from the day, including any taken by passengers.

Stay Off Social Media

Do not post about the trip, the arrest or the case.

Talk to a lawyer before deciding how to proceed. A BWI can look minor because no car was involved, yet it counts as a prior intoxication offense and can affect a driver's license. Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Orange trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Boating While Intoxicated Questions People In Orange Ask

What is the penalty for boating while intoxicated in Orange, TX?

Under Texas Penal Code § 49.06, BWI is a Class B misdemeanor with a minimum of 72 hours in jail, a maximum of 180 days, and a fine of up to $2,000. With one prior intoxication conviction it becomes a Class A misdemeanor with a 30 day minimum, and with two priors it becomes a third degree felony under § 49.09. These are statutory limits, not a prediction for any one case.

Can a BWI in Orange County affect my driver's license?

Texas implied consent law in Transportation Code chapter 724 covers a person arrested for operating a watercraft while intoxicated. Refusing a breath or blood specimen, or giving one at the legal level, can start the same administrative suspension of the driver's license that follows a DWI arrest. The request for an ALR hearing is due within 15 days after the notice is received.

Who arrests people for BWI in Orange County?

Texas Parks and Wildlife Department game wardens are state peace officers and enforce boating laws, including BWI, on public waters across Texas. Local law enforcement agencies with jurisdiction over the water can also make BWI arrests. Wherever the arrest is made, the person is booked into the county jail and the case is prosecuted by the county's prosecutor.

Does a kayak or jet ski count for BWI in Orange, TX?

Penal Code § 49.01 defines a watercraft as a vessel, one or more water skis, an aquaplane, or another device used for transporting or carrying a person on water, other than a device propelled only by the current of water. A jet ski is a vessel. A kayak, a paddleboard or an inflatable falls under the definition or outside it depending on how it is built and moved, which is a question of fact in each case.

Does a BWI count as a prior for a DWI in Orange County?

Penal Code § 49.09 counts a prior conviction for operating a watercraft while intoxicated the same way it counts a prior DWI. A BWI conviction can raise a later DWI to a Class A misdemeanor, and two such priors can make a later DWI or BWI a third degree felony. Texas sets no time limit on those priors.

What if there was a child on the boat during a BWI arrest in Orange, TX?

Since September 1, 2023, Penal Code § 49.061 makes it a state jail felony to operate a watercraft while intoxicated with a passenger younger than 15. The charge is separate from ordinary BWI, and the Transportation Code lets an officer require a breath or blood specimen after a refusal in a case with a child passenger.
