How Does A DWI Affect A Texas Medical License?

The Texas Medical Board licenses physicians under the Medical Practice Act. Occupations Code § 156.001 requires a physician renewing a registration permit to disclose a Class A or Class B misdemeanor conviction or deferred adjudication involving intoxication or alcoholic beverages. Sections 164.051 and 164.052 let the board act on intemperate alcohol use that could endanger a patient.

Understanding Texas Law

What Does The Texas Medical Board Do With A Physician's DWI?

The Texas Medical Board licenses and disciplines physicians under the Medical Practice Act, Subtitle B of Title 3 of the Texas Occupations Code. Unlike some boards, the TMB does not have to reason its way to alcohol offenses through a general criminal history rule. The statute names them.

Section 156.001 governs the registration permit a physician renews to keep practising. It requires the physician to disclose, with the renewal, information not already reported about a felony conviction, or a conviction or deferred adjudication for a Class A or Class B misdemeanor, in listed categories. Intoxication and alcoholic beverage offenses are one of those categories.

A first DWI is a Class B misdemeanor under Penal Code § 49.04. A deferred adjudication on that charge is still inside the disclosure category. So is a conviction reduced to another alcohol offense.

What the board's disciplinary statute reaches:

  • Intemperate use of alcohol or drugs that, in the board's opinion, could endanger a patient, § 164.052
  • Inability to practise with reasonable skill and safety because of drunkenness or excessive use of a substance, § 164.051
  • An answer on a license or renewal application that turns out to be inaccurate

The board's focus is fitness to practise. A DWI with a high result, a crash, or a second arrest raises the question of an underlying substance use problem, and that question is what the board investigates.

How Chapter 53 of the Occupations Code applies to licensed professionals in general is covered on the licensed professionals DWI page.

Real Questions

What Do Physicians Ask About A DWI In Texas?

When do I disclose a DWI to the Texas Medical Board?

Section 156.001 ties the disclosure to the registration renewal and to information not already reported. The wording of the current form, and any other reporting that board rules require, controls the details. The disclosure has to match the actual disposition, so the final judgment should be read before answering.

Does a deferred adjudication keep my record clean for the board?

Section 156.001 names a deferred adjudication for a Class A or Class B misdemeanor in the intoxication category, so it falls inside the renewal disclosure. That is different from some other licenses. A deferred adjudication can still help in other ways, but it does not remove the disclosure question for a physician.

Should I contact the Physician Health Program?

The program accepts self-referrals and referrals from hospitals, residency programs and the board. Whether a self-referral makes sense depends on the test result, any prior history, and what has already been said to an employer or the board. This is a decision to make with advice, not under time pressure.

What about hospital privileges, malpractice insurance and DEA registration?

These sit outside the board and have their own questions and policies. For example, a credentialing form at a hospital may ask about arrests, not only convictions. This is an example, and each form should be read on its own terms. Planning the answers together avoids inconsistent statements.

Possible Defenses

How Can A Physician's DWI Case Be Defended?

Because every outcome lands differently on the renewal form, the defense of the criminal case and the protection of the license are planned together. An attorney reviews the stop, the testing and the evidence, and also tracks which dispositions would trigger the disclosure. No result can be promised.

An incomplete answer to a board question can become a separate disciplinary problem, apart from the DWI. The disclosure has to match the actual disposition, which means waiting to see whether the case ends in a dismissal, a reduction, a deferred adjudication or a conviction, and reading the final judgment before answering.

The license to drive is its own fight.

The ALR hearing before the State Office of Administrative Hearings has to be requested within 15 days of the arrest, and it is the first chance to question the arresting officer under oath.

The Texas Physician Health Program was created by Chapter 167 to get physicians and physician assistants with substance use or mental health issues into treatment before a patient is put at risk. The statute limits what it can take on: it may not accept a referral for a standard of care violation caused by drugs or alcohol, except as board rules provide.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Orange trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Medical License DWI Questions People In Orange Ask

Does a doctor have to report a DWI in Orange, TX to the Texas Medical Board?

Texas Occupations Code § 156.001 requires a physician renewing a registration permit to disclose information not already reported about a Class A or Class B misdemeanor conviction, or a deferred adjudication for one, when the offense involves intoxication or alcoholic beverages. The current renewal form sets out the questions and any other reporting the board's rules require.

Can the Texas Medical Board discipline a physician for a DWI in Orange County?

The board's grounds for discipline in Occupations Code §§ 164.051 and 164.052 include intemperate use of alcohol in a manner that, in the board's opinion, could endanger a patient, and an inability to practice with reasonable skill and safety because of drunkenness. The board looks at the conduct and the physician's fitness, not only whether a conviction was entered.

What is the Texas Physician Health Program for doctors arrested in Orange?

The Texas Physician Health Program, created by Occupations Code Chapter 167, is a confidential program for physicians and physician assistants with substance use or mental health concerns. It accepts self-referrals and referrals from hospitals, residency programs and the Texas Medical Board. By statute it cannot accept a referral for a standard of care violation caused by drugs or alcohol, except as board rules allow.

Does a nondisclosure order keep a physician's Orange County DWI from the medical board?

Government Code § 411.0765 names the Texas Medical Board among the agencies that can still receive criminal history covered by an order of nondisclosure. A nondisclosure order limits what the public sees. It does not stop the board from obtaining the record.

Does a DWI in Orange, TX affect a physician assistant's license?

Physician assistants are licensed by the Texas Physician Assistant Board, which works alongside the Texas Medical Board and has its own statute and rules. The Texas Physician Health Program accepts referrals from that board as well. The PA board's own renewal questions and reporting rules control what a physician assistant discloses.
