ALR Hearing Lawyer In Orange, TX
An ALR hearing is the only way to contest the automatic driver's license suspension that follows a DWI arrest in Texas where a test was failed or refused. It has its own judge, its own issues and a deadline that closes long before the criminal case gets going.
What Is An ALR Hearing In Texas?
An ALR hearing is a civil hearing before a State Office of Administrative Hearings judge on whether the Texas Department of Public Safety can suspend a driver's license after a DWI arrest where a test was failed or refused. Transportation Code chapters 524 and 724 govern it. A written request has to reach DPS within 15 days of receiving the notice of suspension, or the suspension starts on day 40.

Understanding Texas Law
How Does An ALR Hearing Work In Texas?
ALR stands for administrative license revocation. It is a hearing on whether the Texas Department of Public Safety can suspend a driver's license after a DWI arrest. Transportation Code chapter 524 governs it when a breath or blood test came back at the legal level, and chapter 724 governs it when the driver refused a test.
The hearing is not held in the criminal court. A judge employed by the State Office of Administrative Hearings hears it, and DPS presents its side. The criminal case in Orange County carries on separately and has no say over the outcome.
The suspension is automatic unless someone asks for a hearing. The request has to reach DPS within 15 days of receiving the notice of suspension. The officer serves that notice at arrest when a breath test fails or a refusal happens.
When a person agrees to a blood draw, the lab result comes back later and DPS mails the notice. The statute treats a mailed notice as received on the fifth day after it is mailed, and DPS tells drivers who agreed to blood testing that they have 20 days from the mailing date.
What DPS has to prove after a test at the legal level (§ 524.035):
- There was reasonable suspicion to stop the driver or probable cause to arrest
- The driver had an alcohol concentration at the legal level while operating a motor vehicle in a public place or a watercraft
- For a driver under 21, any detectable amount of alcohol while operating
What DPS has to prove after a refusal (§ 724.042):
- Reasonable suspicion or probable cause for the stop or arrest
- Probable cause to believe the person was operating while intoxicated
- The person was arrested and asked to give a specimen
- The person refused
The standard is a preponderance of the evidence, which is lower than the proof beyond a reasonable doubt that the criminal case requires.

Penalties And Consequences
How Long Is A License Suspended After A DWI Arrest In Texas?
A timely request stops the clock. Without one, the suspension begins on day 40 after the notice, even if the criminal charge is later dismissed or never filed. The periods below are what the statutes set, not a forecast for any one driver.
20 days from the mailing date when the notice comes by mail after a blood test.
Counted from the date the notice was served or is treated as received.
One year with a prior alcohol or drug contact in the previous ten years.
Two years with the same kind of prior contact.
- Test result at the legal level
- 90 day suspension. One year if the driving record shows an alcohol or drug related enforcement contact in the ten years before the arrest (§ 524.022).
- Refused breath or blood
- 180 day suspension. Two years with a prior alcohol or drug related enforcement contact in the previous ten years (§ 724.035).
- Deadline to request a hearing
- 15 days from receipt of the notice of suspension (§ 524.031). A mailed notice is treated as received on the fifth day after mailing (§ 524.013).
- If no hearing is requested
- The suspension takes effect on day 40, and the statute does not allow it to be probated (§ 524.021).
- Effect of a timely request
- The request stays the suspension until the date of the judge's final decision (§ 524.032).
- Who hears it
- An administrative law judge of the State Office of Administrative Hearings, not the court handling the DWI. The hearing is recorded (§ 524.033).
- Reinstatement fee
- DPS lists a $125 reinstatement fee for an ALR suspension, due before the license is renewed or reissued.
- If the judge sustains the suspension
- A petition for review has to be filed within 30 days after the decision is final, in a county court at law in the county of arrest (§ 524.041).
A hearing set by DPS cannot be held earlier than the 11th day after the person is notified of it unless both sides agree, and DPS tells drivers to allow up to 60 days for scheduling. The suspension stays on hold in the meantime if the request was timely.

Possible Defenses
How Is An ALR Hearing Contested?
The issues in an ALR case are narrow, and DPS carries them. An attorney reads the officer's sworn report, the notice, the test record and any video to see whether each issue can be proved. If the judge does not find every issue in DPS's favor, the license has to be reinstated.
The statute adds a specific limit. A judge may not find that a driver was at the legal level if the breath or blood analysis showed a result below it when the specimen was taken (§ 524.035).
The hearing record is built from paper and testimony.
DPS relies on the officer's report and the test result. The driver can ask the judge to subpoena the breath test operator or the breath test technical supervisor. That application is due at least five days before the hearing and requires good cause (§ 524.039).
The arresting officer's account of the stop and the arrest can be tested through questions, and the video can be set beside the report. An ALR hearing is often the first time the officer answers questions under oath about what happened.

The Stop
Did the officer have reasonable suspicion to pull the car over or to begin the contact?
The Arrest
Was there probable cause to believe the person was operating while intoxicated?
The Warning
Was the statutory warning read and given in writing before a specimen was requested?
The Specimen Request
Was the person actually asked for a specimen, and what was the response?
The Instrument
Do the maintenance and analysis records support the breath result on the report?
The Timing
Was the request filed on time, counted from the correct notice date?

What Happens After A DWI Arrest In Orange County?
The license case follows statewide law no matter where the arrest happened. Where the criminal case is filed, who prosecutes it and where a person is held are specific to Orange County.
The Notice
The officer serves a notice of suspension at arrest after a failed test or refusal. When a lab result is pending, DPS mails it later.
The Request
A request to DPS inside the 15 day window keeps the suspension from starting on day 40. DPS lists what to include, such as the arrest date, the county and the arresting agency.
The Hearing Letter
DPS sends a letter with the date, time and location of the hearing before a State Office of Administrative Hearings judge.
The Decision
The judge sustains the suspension or orders reinstatement. The decision is final once signed and can be appealed within 30 days.
- Where the criminal case is filed
- A first or second DWI is filed in one of the Orange County Courts at Law. A felony DWI goes to 128th District Court, 163rd District Court, and 260th District Court.
- Who prosecutes
- The Orange County District and County Attorney's Office, which handles misdemeanors and felonies.
- Who makes the arrest
- Orange Police Department, Orange County Sheriff's Office, Texas DPS Highway Patrol, Vidor Police Department, Bridge City Police Department, Pinehurst Police Department, or West Orange Police Department.

- Judicial review of a sustained suspension
- A petition in a county court at law in Orange County, for an arrest made there, filed within 30 days after the decision is final.
- Appeal of the criminal case
- The Ninth Court of Appeals in Beaumont.
The license case and the criminal case run side by side. The DWI court process page walks through the criminal stages, and the breath and field sobriety testing page covers the testing evidence behind both.
Next Steps
What Should You Do After A DWI Arrest To Protect Your License?
The days after an arrest matter because the deadline starts on its own. These steps are general information, not advice for any one person.
Find The Notice Date
Locate the notice of suspension and the date it was served. If you are waiting on a blood result, note the date you were released.
Count The Days
Count 15 days from receipt. For a mailed notice, count from the fifth day after mailing or use the 20 day rule DPS describes.
Gather Your Details
Collect the arrest date, county, agency and officer, your license number and your contact details, which DPS asks for in a request.
Keep Every Paper
Save the notice, bond papers, test paperwork and any property receipts from the Orange County Correctional Facility.
Ask About Driving
Ask what driving, if any, is possible during a suspension, including an occupational license for non-commercial driving.
Mind Commercial Licenses
A commercial driver faces a separate disqualification that an occupational license does not lift.
Talk to a lawyer before the window closes. DPS states that late requests are denied, and the suspension takes effect whether or not the criminal charge is later dropped. Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Orange trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
ALR Hearing Questions People In Orange Ask
How do I request an ALR hearing after a DWI arrest in Orange, TX?
The request goes to the Texas Department of Public Safety within 15 days of receiving the notice of suspension, and DPS lists an online form, mail, email, phone and fax as ways to submit it. If you agreed to a blood test and the notice came by mail, DPS counts 20 days from the mailing date. A request made in time stays the suspension until the judge decides the case.
What happens at an ALR hearing for an Orange County DWI?
An administrative law judge from the State Office of Administrative Hearings decides whether DPS proved its case by a preponderance of the evidence. For a failed test, the issues are the legal basis for the stop or arrest and whether the alcohol concentration was at the legal level. For a refusal, the issues also include whether the person was asked for a specimen and refused. The judge either sustains the suspension or orders the license reinstated.
How long is a license suspended after a DWI arrest in Orange, TX?
Under Transportation Code chapter 524, a failed breath or blood test carries a 90 day suspension, or one year when the driving record shows an alcohol or drug related enforcement contact in the previous ten years. Under chapter 724, a refusal carries 180 days, or two years with that kind of prior contact. These suspensions are separate from any suspension a court imposes after a conviction.
Can I drive to work if my license is suspended after an Orange County DWI?
Texas allows an occupational driver's license under Transportation Code chapter 521, subchapter L. A court grants it by order that sets the hours, days, reasons and areas of driving, and the order bars driving a commercial motor vehicle. The statute caps driving at four hours in a 24 hour period, or up to 12 hours on a showing of necessity, unless the order requires an ignition interlock.
What if I miss the ALR deadline after an arrest in Orange, TX?
DPS states that late requests are denied, and the suspension then takes effect on the 40th day after the notice was served. The criminal case is not affected by the missed deadline and goes forward on its own schedule. An occupational license may still be available for non-commercial driving.
Does winning the ALR hearing in Orange end the DWI case?
The two proceedings are independent. The administrative judge decides only whether the license is suspended, under a lower standard of proof than a criminal trial. The criminal charge continues in the county courts on its own schedule, and a result at the ALR hearing, either way, does not decide guilt or innocence.
