Criminal Defense Strategies Used In Montgomery County Courts
Every criminal defense is built from tools the law already provides. Some test how evidence was gathered, some test whether it is reliable, and some give a jury a legal reason to acquit even when the facts are not disputed. This page walks through each tool and how it applies in Montgomery County.
What Defense Strategies Are Available In A Texas Criminal Case?
Texas law gives a defendant several tools: a right to the state's evidence under art. 39.14, motions to suppress evidence taken unlawfully under art. 38.23, challenges to the reliability of scientific evidence, statutory defenses in Penal Code chapters 8 and 9, a speedy trial claim, and negotiation. The right mix depends on the charge and the file.

Understanding Texas Law
What Tools Does Texas Law Give A Criminal Defendant?
No defense can be built on evidence nobody has seen. Code of Criminal Procedure art. 39.14, the Michael Morton Act, gives the defense a right to the state's file. On a timely request, the state must produce offense reports, recorded statements and other material evidence it holds.
The statute also sets a continuing duty. The state must disclose anything that tends to negate guilt, impeach one of its witnesses or reduce punishment, and the duty does not end when the first batch of discovery arrives.
Discovery is where the other issues surface. The patrol video shows whether a stop was lawful. The warrant file shows what the judge was told. The lab packet shows how a number was produced.
Suppression tests how the evidence was gathered.
The Fourth Amendment and article I, section 9 of the Texas Constitution protect against unreasonable searches and seizures. Art. 38.23 adds a statutory exclusionary rule that reaches evidence obtained in violation of any federal or Texas law, not only the constitutions.
A motion to suppress can aim at:
- A detention without reasonable suspicion
- An arrest without probable cause
- A warrantless search that fits no recognized exception
- A warrant whose affidavit does not show probable cause on its face
- A custodial statement taken without the warnings art. 38.22 requires

Scope Of The Tools
What Can A Defense Challenge In A Texas Criminal Case?
Every tool has limits, and the statutes say what each can and cannot do. The table sets out the main ones. None of this predicts how a case will end.
- Discovery, art. 39.14
- A right to offense reports, recorded statements and material evidence on timely request, plus a continuing duty to disclose evidence that helps the defense.
- Suppression, art. 38.23
- Evidence obtained in violation of the constitutions or any Texas or federal law cannot be used against the accused.
- Statements, art. 38.22
- A custodial statement needs the required warnings and a voluntary waiver to be admitted.
- Scientific reliability
- The party offering expert evidence must show the theory is valid, the technique is valid, and it was applied properly this time, under Rule 702 and Kelly v. State.
- Speedy trial
- Judged on four Barker v. Wingo factors. The remedy for a violation is dismissal.
- Statutory defenses
- Self-defense, defense of others and property, necessity and mistake of fact, each with its own elements and burden.
- Negotiation
- Dismissal, a reduced charge, deferred adjudication or diversion where offered, always subject to court approval.

Possible Defenses
How Does A Texas Defense Attorney Pick The Right Strategy?
The right mix depends on the charge, the evidence and the record. An attorney reads the discovery, listens to the video and then decides which tools fit. Some cases turn on a suppression hearing. Others turn on the lab data, a legal defense, or a negotiated term. No result can be promised.
Some defenses accept that the event happened and give a legal reason it is not a crime. When the evidence raises one, the jury is instructed on it.
Defenses written into the Penal Code:
- Self-defense, § 9.31, with stricter rules for deadly force in § 9.32
- Defense of a third person, § 9.33
- Defense of property, §§ 9.41 and 9.42
- Necessity, § 9.22
- Mistake of fact, § 8.02, when a reasonable mistaken belief negates the required mental state
Self-defense is tied to violent offenses, and the assault page covers the charge itself.

The Stop Or Entry
Was there reasonable suspicion, a valid warrant or a recognized exception?
The Statement
Were the warnings given and was the waiver voluntary?
The Science
Was the testing method valid and correctly applied to this sample?
The Law
Does a statutory defense fit the facts, and who carries the burden on it?
The Delay
Has a long wait harmed the defense under the Barker factors?
The Offer
Does a negotiated term, such as a reduced charge or deferral, serve the goals better than trial?
Local Process
How Do These Tools Work In Montgomery County?
Pretrial motions are heard by the judge assigned to the case, so where the case is filed decides who hears them. The table shows who handles each side locally.
Request The File
The defense asks for discovery under art. 39.14 and reviews video, reports, warrant files and lab packets.
File Motions
Motions to suppress and challenges to scientific reliability are filed and set for a hearing before trial.
Negotiate Or Try The Case
The case can end in dismissal, a plea or a verdict, depending on what the motions and the evidence show.
- Where hearings are held
- Misdemeanors in one of the Montgomery County Courts at Law. Felonies in the district courts at the Montgomery County Criminal Justice Center on 207 W Phillips St. The two sit in separate buildings.
- Who answers for the state
- The Montgomery County District Attorney's Office on felonies. On misdemeanors, Montgomery County District Attorney's Office.
- No Refusal warrants
- A driver who refuses a breath test does not end the testing. The officer contacts an on-duty prosecutor who drafts a blood search warrant, an on-call judge reviews it for probable cause, and if signed, blood is drawn by a nurse over the driver's objection.
- Serious crash cases
- The DA's Office runs a dedicated Vehicular Crimes Unit of prosecutors and investigators that responds directly to crash scenes and handles intoxication manslaughter, intoxication assault and fatal hit and run cases.
- If the case is appealed
- Appeals go to the Ninth Court of Appeals in Beaumont.
The DWI tests and drug possession pages cover the testing behind those charges. The deferred adjudication page covers one negotiated route.
Next Steps
What Should You Do To Protect Your Defense?
These steps are general information, not advice for any one person.
Do Not Talk To Investigators
Statements can end a suppression argument and supply elements of the offense.
Preserve Video And Messages
Dash cameras, doorbell footage and texts can disappear on their own.
List Witnesses
Names and numbers of anyone who saw the event.
Keep Every Paper
The citation, the warrant return, the property receipt and the bond.
Note Deadlines
Some motions and requests have timing rules, and a late filing can lose the point.
Ask Before Any Plea
A plea ends most of these tools, so review the file first.

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Defense Strategy Questions People In Conroe Ask
Can a No Refusal blood warrant be challenged in Montgomery County?
A blood draw taken under a warrant is still covered by the Fourth Amendment and Texas law. Probable cause has to appear within the four corners of the officer's affidavit, the draw has to follow the required procedure, and the lab analysis has to be reliable. Each point can be raised in a pretrial motion before the judge assigned to the case.
What evidence does the state have to share in a Conroe criminal case?
Under Code of Criminal Procedure art. 39.14, the Michael Morton Act, the state must produce offense reports, recorded statements of the defendant and witnesses, and other material evidence it holds once the defense makes a timely request. It must also disclose anything that tends to negate guilt, impeach a state witness or reduce punishment, and that duty continues through the case.
What happens when evidence is gathered illegally in Montgomery County?
Code of Criminal Procedure art. 38.23 bars evidence obtained in violation of the federal or Texas constitution or laws from being used against the accused. A motion to suppress asks the judge to rule before trial. When the facts behind a search are disputed at trial, the jury is told to disregard the evidence if it finds it was obtained illegally.
What is a speedy trial claim in a Montgomery County case?
The Sixth Amendment and article I, section 10 of the Texas Constitution protect the right to a speedy trial. Courts weigh four factors from Barker v. Wingo: the length of the delay, the reason for it, whether the defendant asserted the right, and the harm that resulted. A violation leads to dismissal of the charge.
Who has to prove self-defense in a Conroe assault trial?
Self-defense under Penal Code § 9.31 is a defense, not an affirmative defense. Once some evidence at trial raises it, the jury is instructed on it and the state must disprove it beyond a reasonable doubt. Section 9.32 sets stricter conditions for deadly force, and § 9.33 applies the same ideas to defending another person.
Can a plea agreement be a defense strategy in Conroe, TX?
A negotiated outcome is one of the ways a case can end, alongside dismissal and a verdict. A plea can reduce a charge, remove a deadly weapon finding or open a route such as deferred adjudication. What is offered depends on the charge, the record and what the evidence review shows, and the court has to approve the agreement.
