Mental Health Counselor License DWI Lawyer In Conroe, TX
Licensed Professional Counselors and LPC Associates in Texas are regulated through the Texas Behavioral Health Executive Council, and its reporting rule looks at the result of a DWI case rather than the arrest. This page explains the trigger, how each ending reads under the rule, and how the criminal defense doubles as the reporting plan.
What Must A Texas Counselor Report After A DWI?
A Texas LPC or LPC Associate reports to the Behavioral Health Executive Council under 22 TAC § 884.32, which calls for a written report within 30 days of a conviction, sentence, dispositive agreement, or an order of community supervision or pretrial diversion. The Council's guidance says an arrest alone is not reportable. The underlying charge is DWI under Penal Code § 49.04.

Understanding Texas Law
How Does The Behavioral Health Executive Council Handle An LPC's DWI?
LPCs and LPC Associates hold licenses through the Texas State Board of Examiners of Professional Counselors, which sits under the Texas Behavioral Health Executive Council. The Council also oversees psychologists, social workers and marriage and family therapists, and one set of Council rules covers all of them.
The rule that matters after a DWI is 22 TAC § 884.32, on reportable legal actions. Its list is made of endings: a conviction or sentence, an agreement that disposes of the case, and orders of community supervision or pretrial diversion. Each one opens a 30 day window for a written report.
An arrest on its own, per the Council's enforcement guidance, opens nothing. That is a different shape from boards whose clocks start at booking. A counselor may have nothing to send for months, and then the case resolves and the window opens, or it ends in a way that never opens it.
How each ending reads under Rule 884.32:
- Conviction or sentence. On the list.
- Deferred adjudication. A form of community supervision, so on the list.
- Pretrial diversion. On the list, even though it avoids a conviction.
- A plea agreement that resolves the case. A dispositive agreement, so on the list.
- Dismissal with no agreement or supervision. Not among the listed events.
- Acquittal at trial. Not among the listed events.

Penalties And Consequences
What Are The Penalties And License Consequences For A Counselor's DWI?
There are two tracks of consequences for a counselor. The criminal case carries ordinary DWI penalties, while the licensing track depends on how the case ends. The figures here are statutory limits and reporting rules, not predictions.
Runs from the listed event in Rule 884.32.
Plus a fine of up to $2,000.
Ordered by the court (§ 521.344).
- The offense
- Penal Code § 49.04. A Class B misdemeanor on a first offense, Class A at 0.15 or above or on a second offense.
- Who regulates
- The counselors' board, operating within the Behavioral Health Executive Council.
- Reporting rule
- 22 TAC § 884.32, with 30 days to report a listed legal action in writing.
- The arrest itself
- Not reportable under the Council's enforcement guidance.
- Diversion and deferred
- Both are listed as reportable legal actions.
- Chapter 53 review
- The authority asks whether the offense directly relates to the occupation, then weighs rehabilitation, time elapsed and work history (Occupations Code §§ 53.022 and 53.023).
- Eligibility rule
- 22 TAC § 882.42, ineligibility due to criminal history.
- Driver's license
- An ALR case can start before the criminal case, and a conviction brings a separate court ordered suspension.
The way the case ends determines what the counselor sends the Council and when. A plea, a deferred order or a diversion agreement is on the list. A dismissal with no agreement is not.
Real Questions
What Do Counselors Ask About A DWI In Texas?
Do I report the arrest or wait for the outcome?
Does deferred adjudication protect my license?
What might a timeline look like?
Does a No Refusal blood result matter to the board?
Possible Defenses
How Can A Counselor's DWI Be Defended?
The criminal defense begins with the evidence, as in any first DWI. An attorney reviews the stop, the field tests, the breath or blood result and the video, and asks what the state can prove. No result can be promised.
The license side adds a second question: which resolution, if any, would be reportable under Rule 884.32, and what would it mean for the counselor's work.
An alcohol charge close to the work itself.
Many LPCs treat clients whose lives have been shaped by alcohol and drugs, and some supervise associates or run practices. That puts an alcohol related charge nearer the center of the profession than it sits for most license holders, and the Council reads a report with the counselor's role in mind.
Seeking an assessment or treatment after an arrest is the counselor's own clinical and personal call. It can carry weight with the Council and it creates records of its own, so its timing is worth thinking through next to the criminal case.

The Stop
Was there a lawful reason to stop or detain the driver?
The Test
Was the breath or blood sample collected and analyzed correctly?
Which Resolution
Would a dismissal, a plea, a deferred order or a diversion agreement start the 30 days?
The Timing
When would the report be due under each possible ending?
The Report Itself
Does the description stay with the court documents and nothing more?
Later Relief
Could the case end in a way that opens expunction or nondisclosure?
Local Process
What Happens After A Counselor's DWI Arrest In Montgomery County?
The criminal process and the Council's rules follow state law. A counselor's report asks for the case number, the court and the county, and those details come from the Montgomery County court record exactly as it reads.
The Driver's License
An ALR hearing request goes to DPS within 15 days after the notice is received, long before the Council is involved.
The Evidence
The stop, the field tests, and any breath or blood result, including a blood draw under a No Refusal warrant.
The Resolution
The ending of the case, read against the Council's list before it is agreed to.
The Report
If a listed event occurs, a written report within 30 days with the court details.
- Where it is filed
- A misdemeanor DWI is filed in one of the Montgomery County Courts at Law and prosecuted by Montgomery County District Attorney's Office. A felony is heard in the district courts at the Montgomery County Criminal Justice Center on 207 W Phillips St, a separate building.
- Who makes the arrest
- Conroe Police Department, Montgomery County Sheriff's Office, Texas DPS Highway Patrol, Montgomery County Constables, Precincts 1 through 5, Willis Police Department, Shenandoah Police Department, Oak Ridge North Police Department, Magnolia Police Department, Splendora Police Department, or Roman Forest Police Department.
- Where you are booked
- The Montgomery County Jail at 1 Criminal Justice Drive, run by the Montgomery County Sheriff's Office.
- If the case is appealed
- Appeals go to the Ninth Court of Appeals in Beaumont.
Relief later does not recall a report. A dismissal can support an expunction, and a first DWI below 0.15 can qualify for nondisclosure, but those remedies deal with the public criminal record. A report already made under Rule 884.32 is a separate filing in a separate file. The deferred adjudication page explains that outcome, and psychologists, who answer to the same Council, are covered on the psychologist license page.
Next Steps
What Should A Counselor Do After A DWI Arrest?
A counselor's early choices set both the criminal defense and the later report, so the order of steps matters. These steps are general information, not advice for any one person.
Count 15 Days
Find the date on the notice of suspension and count 15 days from the day you received it.
Read Your Own Forms
Read the renewal and employer questions word by word, since some ask about arrests.
Track Every Order
Note the date of any plea, sentence, supervision or diversion order, because the 30 days run from it.
Keep Reports Short
When a report is due, stay with the case number, the court, the county and a plain description.
Think About Clients
Consider how a pending case touches client notices and supervision duties, and ask before changing a caseload.
Keep Every Paper
Save the citation, bond papers and each court document, since the report is built from them.

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Counselor License DWI Questions People In Conroe Ask
Does an LPC have to report a DWI arrest in Conroe, TX right away?
Rule 884.32 in 22 TAC, the Council's reportable legal actions rule, lists endings rather than beginnings. A conviction, sentence, dispositive agreement, community supervision order or pretrial diversion order each starts a 30 day window for a written report. The Council's enforcement guidance treats a bare arrest as outside the rule, so nothing is owed under it on the arrest alone.
Which outcomes of a Montgomery County DWI are reportable for a counselor?
Rule 884.32 lists a conviction, a sentence, a dispositive agreement, and orders of community supervision or pretrial diversion. Deferred adjudication is a form of community supervision, so it falls within the list. A dismissal that involves no agreement and no order of supervision is not among the listed events.
Does pretrial diversion on a DWI in Conroe, TX have to be reported to the Council?
An order placing a licensee on pretrial diversion is one of the events Rule 884.32 names, with a written report due within 30 days. Diversion can keep a conviction off the record and may open the door to an expunction later, but it does not take a counselor outside the rule. The diversion order is itself the reportable event.
What court details go in an LPC's report of a Montgomery County DWI?
A report under the Council's rule identifies the matter by case number, court and county of filing, and adds a description of what is being reported. For a misdemeanor DWI in Montgomery County the court is one of the county Courts at Law, and the judgment or order shows which one and the case number. The description becomes part of the licensee's regulatory file.
How does the Council decide whether a DWI matters to a counselor in Conroe, TX?
Occupations Code chapter 53 lets a licensing authority act on a conviction that directly relates to the duties of the occupation, and it lists factors such as the nature of the crime and how it relates to the license's purpose. The authority then weighs time elapsed, rehabilitation and work history. How that review applies to a given license and case is a question under the Council's rules.
Can an LPC Associate with a Montgomery County DWI still reach a full license?
An associate is a licensee of the same board and falls under the same Council rules on criminal history and reporting. The Council reviews criminal history again when it considers an application for the full license, under its rule on ineligibility due to criminal history at 22 TAC § 882.42.
