Discharge Of A Firearm In A Municipality Lawyer In Conroe, TX
No single Texas statute covers firing a gun in town. The city, the place the shot was fired, where the round traveled and who was nearby decide whether the case is a fine, a misdemeanor or a felony, and this page explains each and how they are defended.
Is It A Crime To Fire A Gun In A Texas City?
Texas has no single statute for it. A city may regulate discharge inside its limits under Local Government Code § 229.001, and state law can add disorderly conduct under Penal Code § 42.01, reckless discharge under § 42.12 in cities of 100,000 or more, or deadly conduct under § 22.05, which is a felony when a shot is fired toward people or an occupied place.
Understanding Texas Law
How Does Texas Law Treat A Gun Fired Inside A City?
Texas splits authority over gunfire in town between cities and the state, and more than one law can reach a single shot. The first question is whether the shot was inside a city.
Texas Local Government Code § 229.001 takes away most of a city's power over firearms. A city cannot regulate how guns are possessed, carried or transferred. It keeps the power to regulate discharge inside its limits, except at a sport shooting range. Chapter 229 also limits how far a city's rules reach into annexed land.
In the unincorporated parts of Montgomery County, no city ordinance applies, and the state statutes carry the case.
Laws that can apply to one trigger pull:
- A city discharge ordinance, enforced in municipal court
- Section 42.12, reckless discharge, in cities of 100,000 or more
- Section 42.01(a)(7), firing a gun in a public place
- Section 42.01(a)(9), firing on or across a public road
- Section 22.05, deadly conduct, when people or occupied places were put at risk
When statutes overlap, the prosecutor chooses. Section 42.12 says conduct that violates it and another law may be prosecuted under either, and it leaves city ordinances in place.

Possible Defenses
How Can A Firearm Discharge Charge Be Defended?
The state must prove who fired, where, in which direction and with what mental state. An attorney reviews the scene evidence and the witness accounts to see where the facts and the charge do not line up. No result can be promised.
A shot fired in response to a threat raises Chapter 9. Once the evidence raises justification, the state carries the burden of disproving it.
Evidence and constitutional issues.
Shell casings, bullet strikes, video and witness statements form most of the file. If officers found the gun through a stop, a search or consent, each step can be tested against the Constitution and Texas law. Statements given at the scene can be reviewed for the warnings required in custody.
Shouting or display without a shot belongs under disorderly conduct instead.

The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Firearm Discharge Questions People In Conroe Ask
Can a city in Montgomery County ban firing a gun inside its limits?
Texas Local Government Code § 229.001 stops cities from regulating most firearm subjects, such as possession, carrying and transfer, but it keeps a city's authority to regulate the discharge of firearms inside its limits, other than at a sport shooting range. A violation of a city discharge ordinance is a fine-only offense heard in that city's municipal court.
Does Penal Code § 42.12 apply to a shot fired in Conroe, TX?
Section 42.12 makes recklessly discharging a firearm inside a city's limits a Class A misdemeanor, but only in a municipality with a population of 100,000 or more. Whether it reaches a particular shot depends on the population of the city where the shot was fired, as the law counts it. Where § 42.12 does not apply, disorderly conduct and deadly conduct remain available, along with any city ordinance.
What is the charge for firing a gun toward a house in Montgomery County?
Knowingly discharging a firearm at or in the direction of a habitation, building or vehicle while reckless about whether it is occupied is deadly conduct under Texas Penal Code § 22.05(b). The same subsection covers firing at or toward one or more individuals. It is a third degree felony, with two to ten years in prison and a fine of up to $10,000.
Is shooting into the air on New Year's Eve illegal in Conroe?
Firing into the air can be charged several ways. In a public place it can be Class B disorderly conduct under § 42.01(a)(7). Inside a city it can break a discharge ordinance. If a round hits property, criminal mischief can follow, and conduct that puts someone in imminent danger of serious bodily injury fits Class A deadly conduct under § 22.05(a).
What if the gun was fired in self-defense in Montgomery County?
Chapter 9 of the Texas Penal Code explains when force and deadly force are justified, including defense of oneself, another person or property. When the evidence raises justification, the state has to disprove it beyond a reasonable doubt. Whether it applies turns on the threat, the response and the circumstances at the moment of the shot.
Where is a firearm discharge case heard in Montgomery County?
A city ordinance violation is heard in that city's municipal court. State misdemeanors such as Class B disorderly conduct and Class A deadly conduct are filed in one of the Montgomery County Courts at Law. Felony deadly conduct goes to a grand jury and then to the district courts at the Criminal Justice Center, prosecuted by the District Attorney's Office.
