Small Business Owner DWI Lawyer In Conroe, TX
An owner-operator has no board to report to and no one to hand the keys to. This page explains how a DWI in Montgomery County can reach the truck, the insurance policy, the calendar and the contracts, and what options exist to keep the business moving.
How Does A DWI Affect A Small Business Owner In Texas?
A DWI is charged under Penal Code § 49.04 the same way for an owner as for anyone. For a business, the effects land on driving, insurance, court dates and contracts. The license case runs on a 15 day deadline, and an occupational license under Transportation Code Chapter 521 can restore limited driving during a suspension.

Understanding The Impact
How Can A DWI Affect A Small Business Owner In Texas?
A DWI is a criminal charge under Penal Code § 49.04. For a small business owner it is also an operations problem. No licensing board opens a file, but the business can feel the case in ways an employee's job never would.
Driving comes first. The arrest starts an administrative case against the driver's license with its own deadline. Day 15 is the last day to ask for an ALR hearing, and if that day passes the suspension starts on day 40. For an owner whose service area reaches The Woodlands, Willis, Montgomery, Magnolia, Shenandoah, Oak Ridge North, Panorama Village, Cut and Shoot, Splendora, New Caney, and Porter, that date can matter more than the first court setting.
The rest arrives over the following months: a commercial policy renewal, weekday court settings and customer or bonding paperwork that asks about criminal history.
A first-month list for an owner after a DWI arrest:
- The ALR hearing request, inside the 15 day window
- A plan for the company vehicles the owner drives if a suspension begins
- The renewal date on the commercial auto policy
- Upcoming bids, bond renewals or vendor forms that ask about criminal history
- Any trade or professional license the owner holds, and its own reporting rules
None of these follows automatically from an arrest. Each is worth knowing about early instead of discovering on a deadline.

Penalties And Consequences
What Are The Penalties And Business Risks Of A DWI In Texas?
Owning the company does not change the statute's range. It changes the cost of each piece of it, because every day in court or off the road is a day the business runs short. These are statutory limits, not predictions.
A Class B misdemeanor, or Class A when the result is 0.15 or more.
Court costs come on top.
A court can allow up to 12 for good cause, and an interlock order removes the cap.
- Classification
- Class B misdemeanor on a first offense. Class A at 0.15 or above.
- Jail range
- 72 hours to 180 days on a first offense, set by the court within that range.
- Fine
- Up to $2,000 on a Class B, with court costs added.
- ALR suspension
- 90 days for a failed test, 180 days for a first refusal, unless a hearing is requested within 15 days after notice.
- Occupational license
- Transportation Code Chapter 521, with hour limits under § 521.248 unless an ignition interlock is ordered.
- No Refusal periods
- Weekends, holidays and selected enforcement periods, publicized in advance. A refusal during one can lead to a warrant blood draw.
- Commercial drivers
- A CDL has its own disqualification rules, covered on the commercial vehicle DWI page.

Possible Defenses
How Can A Business Owner's DWI Be Defended?
The defense starts where any first DWI does: the stop, the field sobriety tests and the science behind any number. An attorney reviews the file to see what the state can prove. No result can be promised.
For an owner, the shape of the result matters for business paperwork. A dismissal, a reduction, a deferred adjudication and a conviction answer vendor and bond questions differently.
The blood evidence can still be tested.
A warrant depends on the probable cause shown in the officer's affidavit, and the draw, the handling of the sample and the lab work each have to hold up. The DWI tests page covers those issues.
A later expunction or nondisclosure order can change what a background check returns. Owners who also hold a state professional license face a second set of rules, explained on the licensed professionals page.
The Stop
Was there a lawful reason to stop or detain the driver?
The Testing
Were field tests, breath or blood testing done and recorded correctly?
The ALR Hearing
Can the officer's reasons for the stop and arrest be tested at the license hearing?
The Result On Paper
Would a proposed plea read as a conviction, a deferred adjudication or a dismissal on later forms?
Occupational License
Is an application ready if a suspension begins, and does it need an interlock?
Scheduling
Can court dates be arranged around the busiest stretches of the business calendar?

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Small Business Owner DWI Questions People In Conroe Ask
How does a business owner keep driving after a DWI arrest in Conroe, TX?
The first step is the ALR hearing request, due within 15 days after the notice of suspension is received. Otherwise the suspension takes effect on the 40th day. If a suspension does begin, Transportation Code Chapter 521 lets a court grant an occupational driver's license for essential needs, including work. Under § 521.248 the cap is four hours of driving a day, which a court can raise to as many as 12 for good cause, and the cap falls away when the order requires an ignition interlock.
What changes when an occupational license in Montgomery County requires an interlock?
Under Transportation Code § 521.248, an order that requires an ignition interlock removes the hour, reason and location limits that would otherwise apply. The vehicle has to carry the device, which requires a breath sample before the engine starts. For an owner driving between job sites all day, the difference is between a capped schedule and an open one.
Does refusing a breath test in Conroe, TX protect a business owner's driving privilege?
A refusal carries its own ALR suspension, 180 days on a first refusal under Transportation Code § 724.035, compared with 90 days for a test result at or above the limit. During Montgomery County No Refusal periods a refusal can also lead to a warrant and a blood draw, so the file may hold a test result as well as the longer suspension.
Can a DWI affect a company's commercial auto insurance in Conroe, TX?
Commercial auto policies are written on the listed drivers, and insurers check motor vehicle records at renewal. An ALR suspension or a conviction can show up on that record. What a particular carrier does with it, such as a surcharge, excluding the driver or declining to renew, depends on the policy terms and that carrier's underwriting rules.
Do customer contracts or bonds ask about a DWI in Montgomery County?
Some do. Surety bond applications, government contract forms, vendor qualification packets and certain trade licenses include criminal history questions, and they differ in what they cover and how far back they reach. Whether an open case, a deferred adjudication or only a final conviction belongs on a given form turns on that form's own language.
Can my business keep operating if an employee drives and I cannot in Conroe, TX?
A suspension limits the owner's own driving, not the company's ability to operate through other licensed drivers. Insurers and customers may still ask about the owner's record, and an owner who is a listed driver may need to review the policy. Lining up who covers driving tasks early is a practical step.
