What Is Possession Of A Fake ID In Texas?

Under Transportation Code § 521.451, it is a Class A misdemeanor to display or possess a driver's license or ID card the person knows is fictitious or altered, or to use one issued to someone else. Related offenses include a Class C for a novelty card under § 521.453 and a Class C for a minor lying about age to obtain alcohol.

Understanding Texas Law

How Does Texas Law Treat A Fake ID?

A fake ID arrest is not one offense. The charge depends on what the card is and what the person did with it, and three different codes can apply.

  • The card: Transportation Code § 521.451 covers holding or using a fictitious, altered or borrowed license, a Class A misdemeanor. Section 521.453 covers a lookalike novelty card, a Class C for someone under 21
  • The drink: Alcoholic Beverage Code § 106.07 covers a person under 21 who lies about age to get alcohol, a Class C misdemeanor
  • Making or selling: Penal Code § 37.10, tampering with a governmental record, is where felony charges come from

Section 521.451(c) adds a twist. When conduct violates both § 521.451 and § 106.07, the person may be prosecuted only under § 106.07.

Section 521.451 makes it an offense to:

  • Display or possess a license or ID card known to be fictitious or altered
  • Lend a license to someone else, or knowingly let them use it
  • Display or represent as one's own a license issued to someone else
  • Possess more than one currently valid license or certificate
  • Give a false name, address or counterfeit document, or commit fraud, on an application

Several of these require knowledge. The state has to prove the person knew the card was fake or altered.

Real Questions

What Do People Ask About A Fake ID In Texas?

What if I did not know the card was fake?

Section 521.451 requires knowledge for the fictitious or altered card offense. A card ordered online and sold as a novelty, or a sibling's license left in a borrowed jacket, raises real questions about what the person knew. This is an example, not a real case. The evidence about where the card came from and how it was used is reviewed closely.

Can one night produce two charges?

Section 521.451(c) limits the stacking. When one act violates both the Transportation Code section and the Alcoholic Beverage Code misrepresentation of age section, the person may be prosecuted only under the alcohol section. A different act, such as keeping a counterfeit license separate from using it, can still be reviewed on its own facts.

Is a college ID or a work badge a problem?

Those are not government licenses, so § 521.451 does not describe them. The novelty card rule looks at a document that is deceptively similar to a driver's license or ID card and meant to show the person as 21 or older. A card that makes no such claim is a different case.

Does the bar or store keep the card?

A business that takes a card often turns it over to police, and an officer can confiscate a lookalike card that lacks the required statement. What happens next depends on the code the officer cites. The card itself becomes physical evidence in the case.

Possible Defenses

How Can A Fake ID Charge Be Defended?

The state has to prove knowledge, possession or use, and that the card fits the statute charged. An attorney examines the card, the report and the statements to see where the evidence and the charge do not line up. No result can be promised.

Whether the card is a counterfeit government license or a novelty item decides which statute fits at all.

Evidence and constitutional issues.

The card, any store video and the officer's account make up most of the file. If the card was found in a search, the reason for the stop or detention and the scope of the search can be reviewed. Statements made at the scene can be checked for required warnings.

If the night also involved driving after drinking, see underage DUI. A case that ends in dismissal can be cleared through an expunction.

Local Process

What Happens After A Fake ID Arrest In Montgomery County?

The code charged sets the court. A Class C citation is heard in a justice or municipal court, and a Class A charge in the county's misdemeanor courts.

  1. The Card Is Seized

An officer or venue staff member takes the card, and the officer decides which code to cite or arrest under.

  2. Ticket Or Charge

A Class C citation goes to a justice or municipal court. A Class A charge is filed with the misdemeanor courts.

  3. Resolution

Deferred disposition is available on many Class C citations. Class A charges can end in dismissal, a reduction, deferred adjudication, a plea or a trial.

Class A cases
Filed in one of the Montgomery County Courts at Law and prosecuted by Montgomery County District Attorney's Office.
Class C citations
A justice of the peace court, or a municipal court when a city officer wrote the citation.
Felony cases
Grand jury, then heard in the district courts at the Montgomery County Criminal Justice Center on 207 W Phillips St, prosecuted by the Montgomery County District Attorney's Office.
Who makes the arrest
Conroe Police Department, Montgomery County Sheriff's Office, Texas DPS Highway Patrol, Montgomery County Constables, Precincts 1 through 5, Willis Police Department, Shenandoah Police Department, Oak Ridge North Police Department, Magnolia Police Department, Splendora Police Department, or Roman Forest Police Department.
Where you are booked
The Montgomery County Jail at 1 Criminal Justice Drive.
If the case is appealed
Appeals go to the Ninth Court of Appeals in Beaumont.

A Class A outcome such as deferred adjudication can lead to a later order of nondisclosure.

Next Steps

What Should You Do After A Fake ID Charge?

These steps are general information, not advice for any one person.

Read The Citation

Find the code section, since the section decides the class and the court.

Do Not Explain The Card

Statements about where it came from can supply the knowledge element.

Write Down The Source

Note where and how the card was obtained and who else had it.

Check The Court Date

Missing a Class C date can add a warrant.

Tell Parents Or A Lawyer Early

Young defendants can face school and license consequences too.

Ask Before Paying A Ticket

Paying a citation is a plea, so ask about deferred disposition first.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Fake ID Questions People In Conroe Ask

What is the penalty for a fake ID in Conroe, TX?

Displaying or possessing a driver's license or ID card the person knows is fictitious or altered is a Class A misdemeanor under Texas Transportation Code § 521.451, with up to one year in county jail and a fine of up to $4,000. Lying about age to get alcohol is a separate Class C offense, and making or selling license documents can be charged as a felony.

Is using my older sibling's license a crime in Montgomery County?

Section 521.451 makes it an offense to display or represent as one's own a license issued to someone else. It is also an offense to lend a license to another person or knowingly let someone use it. The person using the card and the person who lent it can both be charged with a Class A misdemeanor.

What happens if I show a fake ID at a bar in Conroe?

A person under 21 who falsely states they are 21 or older, or shows a document claiming it, to someone selling or serving alcohol can be charged with misrepresentation of age under Alcoholic Beverage Code § 106.07, a Class C misdemeanor. Section 521.451(c) says that when conduct violates both § 521.451 and § 106.07, the person may be prosecuted only under § 106.07.

Is a novelty ID card illegal in Montgomery County?

Transportation Code § 521.453 makes it a Class C offense for a person under 21 to possess a document intended to represent that the person is 21 or older, that is deceptively similar to a driver's license or ID card, and that lacks the required red 'NOT A GOVERNMENT DOCUMENT' statement. A true counterfeit of a government license falls under § 521.451 instead.

Can making fake IDs be charged as a felony in Montgomery County?

Making, selling or presenting a false government license can be charged as tampering with a governmental record under Penal Code § 37.10. For a license, certificate, permit or similar government document, the offense is a third degree felony, and it rises to a second degree felony with intent to defraud or harm another. Intent is presumed when two or more records of the same type are involved.

Can a fake ID arrest in Conroe, TX come off my record?

A charge that ends in dismissal or acquittal can be eligible for expunction. For Class C offenses, Texas provides deferred disposition, and a case dismissed after completing it can also qualify. A final conviction on a Class A fictitious license charge stays on the record, though some resolutions can qualify for an order of nondisclosure depending on the person's history.
