Law License DWI Lawyer In Conroe, TX

A lawyer's license is issued under the authority of the Supreme Court of Texas, which puts a DWI outside the statute that governs most other licenses. This page covers the disciplinary rules for lawyers, the admission rules for applicants, the penalties and the first steps.

Knowing the law does not pause the ALR clock. A hearing on the driver's license has to be requested within 15 days after you receive the notice of suspension, the same as for any other driver.

How Does A DWI Affect A Texas Law License?

Texas lawyers are governed by the Texas Disciplinary Rules of Professional Conduct. Rule 8.04(a)(2) bars a serious crime or another criminal act that reflects adversely on fitness as a lawyer. A misdemeanor DWI is not a serious crime as the rules define it, but fitness can still be questioned. Bar applicants answer to the Board of Law Examiners.

Understanding Texas Law

How Do The Texas Disciplinary Rules Treat A Lawyer's DWI?

Texas lawyers hold their licenses under the authority of the Supreme Court of Texas. The State Bar of Texas administers membership, and the Office of Chief Disciplinary Counsel handles grievances under the Texas Rules of Disciplinary Procedure. Conduct is measured by the Texas Disciplinary Rules of Professional Conduct.

Criminal conduct is addressed in Rule 8.04(a)(2), which has two parts. The first bars a lawyer from committing a serious crime. The second bars any other criminal act that reflects adversely on the lawyer's honesty, trustworthiness or fitness to practise law.

A misdemeanor DWI does not fit the first part. In a misdemeanor case the live question is the second part: whether this particular act reflects adversely on fitness. That is fact driven. A single arrest reads differently from a pattern of them, from a crash that hurt someone, or from conduct toward officers at the scene.

What counts as a serious crime under the rules:

  • Barratry
  • Any felony that involves moral turpitude
  • A misdemeanor built on theft, embezzlement, or fraudulent or reckless misappropriation of money or property
  • Attempting, conspiring or soliciting to commit one of those

Compulsory discipline is tied to that definition and to intentional crimes. A felony DWI, such as a third DWI, is measured against the moral turpitude element rather than the felony label alone.

Occupations Code § 53.002 takes licenses issued under the Supreme Court of Texas out of Chapter 53. The framework other boards use is on the licensed professionals page, and for lawyers most of it gives way to the Supreme Court's own rules.

Penalties And Consequences

What Are The Consequences Of A DWI For A Texas Lawyer?

The criminal range is the same for a lawyer as for anyone else. What differs is the second track: discipline rules for lawyers and a character and fitness process for applicants. Chapter 53 of the Occupations Code, the general statute on criminal history and licensing, does not apply to licenses issued under the Supreme Court's authority.

These are rule texts, not predictions. How the disciplinary system or the board treats a particular DWI depends on the facts.

Real Questions

What Do Lawyers And Bar Applicants Ask About A DWI In Texas?

As a lawyer, must I report my own DWI arrest to the State Bar?

Whether a reporting duty applies depends on the current text of the disciplinary rules and the Rules of Disciplinary Procedure, which address when a conviction or probation must be reported. A misdemeanor DWI is not a serious crime as the rules define it, but the exact duties should be read against the facts before anything is filed.

What if the charge is reduced or dismissed?

The disposition matters for discipline and for admission. For example, a dismissal leaves no conviction or probation to report, while a plea can raise new reporting questions. This is an example, not a real case. Each outcome also affects the Board of Law Examiners file differently, so the plan for the criminal case and the plan for the license belong together.

I am a law student. What if I am arrested before filing my bar application?

The Declaration of Intention to Study Law and the bar application both ask about criminal history. An arrest before filing has to be described accurately. How the case ends, and how the disclosure describes it, both feed the character and fitness review, and an incomplete answer can become a separate problem.

Is it safe to call TLAP?

TLAP communications are confidential under Chapter 467, and TLAP states that it does not share information with the State Bar, the Board of Law Examiners or disciplinary counsel, with narrow legal exceptions. Whether and when to call is a personal decision worth discussing with a lawyer.

Possible Defenses

How Can A Lawyer's DWI Case Be Defended?

For a lawyer or an applicant, the criminal case sets the record that every later reviewer reads. An attorney reviews the stop, the testing and the paperwork, and plans ahead for how each possible outcome would read to the bar. No result can be promised.

A lawyer who practises in Montgomery County may walk into the same courthouse as a defendant that they walk into as an advocate. That familiarity removes some of the fear, and it invites shortcuts: a quick word with a prosecutor, an informal account of the night, an assumption that the case will sort itself out.

The early work is technical, and it is hard to do for yourself.

The ALR hearing is the first chance to question the arresting officer under oath, and it has to be requested within 15 days. If a breath test was refused during a No Refusal period, a blood warrant may be in the file, and that warrant stands or falls on the probable cause shown in its affidavit, the draw and the lab's analysis.

Every one of those tasks is harder to do with detachment when the license on the line is your own.

The Stop

Was there a lawful reason to stop or detain the driver?

The Testing

Were roadside, breath or blood results collected and run correctly?

The Disposition

Which outcomes leave no conviction or probation to report?

The Disclosure

Is every filing with the bar or the board accurate and consistent with the court record?

The Fitness Question

What facts bear on Rule 8.04(a)(2) beyond the charge itself?

The Record Afterward

Would expunction or nondisclosure help, and who can still see the record?

Local Process

What Happens After A Lawyer's DWI Arrest In Montgomery County?

The criminal case follows Texas law and runs in Montgomery County. The bar and board tracks run on their own rules and their own schedules.

  1. Booking And Bond

After the arrest the lawyer or applicant is booked, then brought before a magistrate who sets bond.

  2. The ALR Window

The driver's license hearing has to be requested within 15 days, or the suspension starts on day 40.

  3. Court Settings

The case is set, and the defense asks for the state's evidence.

  4. Resolution And Reporting

The outcome sets what, if anything, must be reported to the bar or the board.

Misdemeanor DWI
Filed in one of the Montgomery County Courts at Law and prosecuted by Montgomery County District Attorney's Office.
Felony DWI
Heard in the district courts at the Montgomery County Criminal Justice Center on 207 W Phillips St. The Montgomery County District Attorney's Office works from the same building.
Booking
The Montgomery County Jail, run by the Montgomery County Sheriff's Office.
If the case is appealed
Appeals go to the Ninth Court of Appeals in Beaumont.

Applicants and the Board of Law Examiners are a separate matter. A pending Declaration of Intention to Study Law has to be amended when information changes, and the board's rules let it require an evaluation by a professional it designates if it finds an applicant may have a chemical dependency. A nondisclosure order does not hide the record from the board or the State Bar, as the nondisclosures page explains.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Law License DWI Questions People In Conroe Ask

Is a misdemeanor DWI in Conroe a serious crime under the Texas lawyer discipline rules?

Under the rules' definition, a serious crime covers barratry, any felony involving moral turpitude, misdemeanors involving theft, embezzlement, or fraudulent or reckless misappropriation of money or property, and any attempt, conspiracy or solicitation to commit one of those. A misdemeanor DWI falls outside that definition. The Texas Rules of Disciplinary Procedure reserve compulsory discipline for serious and intentional crimes in that defined sense.

Can a Texas lawyer face a grievance over a Montgomery County DWI without a conviction?

Rule 8.04(a)(2) is framed around committing a criminal act that reflects adversely on a lawyer's honesty, trustworthiness or fitness, not around a conviction alone. Compulsory discipline is tied to a conviction or probation for a serious or intentional crime. Any other grievance moves through the ordinary disciplinary process under the Texas Rules of Disciplinary Procedure, where the facts of the conduct are what get examined.

Does a law student arrested in Conroe have to update the Board of Law Examiners?

Criminal history questions appear on both the Declaration of Intention to Study Law and the bar application. A pending declaration carries a continuing duty to amend it when information changes, and an arrest that happens after filing is new information of exactly that sort. The board reviews character and fitness from those filings and can require a chemical dependency evaluation.

Can a lawyer represent themselves on a DWI in Montgomery County?

Any defendant in a Texas criminal case has the right to self-representation, and a lawyer is no exception. Doing so means running the ALR hearing, the discovery review and any trial while also being the person with the most at stake in the result. The disciplinary rules and the criminal case run on separate tracks whichever way the defense is handled.

Does a nondisclosure order keep a Montgomery County DWI from the State Bar of Texas?

Government Code § 411.0765 names both the State Bar of Texas and the Board of Law Examiners among the entities that can still receive criminal history covered by an order of nondisclosure. The order limits public access to the record. It does not close the record to those two bodies.

Is the Texas Lawyers' Assistance Program confidential for a lawyer arrested in Conroe?

Communications with TLAP are confidential under Chapter 467 of the Health and Safety Code. TLAP states that it does not share information from a lawyer, law student or judge with the State Bar, the Board of Law Examiners, disciplinary counsel or any other disciplinary body, apart from narrow exceptions set by law.
