Police officer handcuffing a driver beside a vehicle after a DWI traffic stop

Motorcycle DWI Lawyer In Conroe, TX

Texas has no special DWI offense for riders. A motorcycle case is built on the same statute as a car case, yet the reason for the stop, the roadside tests and any crash evidence all look different. This page covers what the state must prove, the penalties, how riders are evaluated and how these cases are defended.

A suspension reaches every license class you hold. A request for an ALR hearing is due within 15 days after you receive the notice of suspension, which the officer may hand you at arrest. The suspension applies to your whole driving privilege, so it can cover a car as well as the motorcycle.

What Is A Motorcycle DWI In Texas?

A motorcycle DWI is a charge under Texas Penal Code § 49.04 for operating a motorcycle in a public place while intoxicated. A motorcycle counts as a motor vehicle, so the offense levels match a car DWI. The central question is proof: whether the rider was intoxicated and whether the officer's cues and tests hold up.

Understanding Texas Law

How Does Texas Law Define A Motorcycle DWI?

A rider is charged under Texas Penal Code § 49.04, the statute behind every DWI. The DWI chapter defines a motor vehicle as any device in, on or by which a person or property is or may be carried on a highway. That reaches motorcycles, mopeds, scooters and three wheel trikes.

The state has to prove that the rider was operating the motorcycle in a public place while intoxicated. Section 49.01 gives two ways to meet the last element, and the state may use either one.

  • A blood, breath or urine alcohol concentration of 0.08 or more
  • Loss of the normal use of mind or body from alcohol, a drug or another substance

The second route needs no test number. An officer who believes a rider's balance, judgment or reaction time was off can build a charge on what was seen.

What the state must prove beyond a reasonable doubt:

  • The person was operating a motor vehicle, here the motorcycle
  • The motorcycle was in a public place in Montgomery County
  • The person was intoxicated at that moment

Operating is not limited to riding down the road. Texas courts have treated steps toward putting a vehicle in motion as operation, so a rider on a running bike in a parking lot can face the charge. The engine, the key, the kickstand and the spot where the bike sat all become facts.

A result of 0.15 or more, an open container or a crash can lift the charge above a basic Class B offense. The base charge is explained on the first DWI page.

Penalties And Consequences

What Are The Penalties For A Motorcycle DWI In Texas?

A rider faces the same criminal range as a driver. These are the limits the statutes allow, not forecasts for any one case. The license consequences reach every vehicle, not only the bike.

$2,000
Maximum fine, Class B first offense

Up to $4,000 and one year for a Class A.

90 days to 1 year
License suspension after a conviction

Separate from the ALR case.

Day 40
ALR suspension starts without a hearing request

Classification
Class B misdemeanor for a first offense. Class A with a result of 0.15 or more, or with one prior DWI. Third degree felony with two prior convictions.
Jail on a first offense
72 hours to 180 days. The minimum becomes six days if an open container was in the rider's immediate possession.
Fine on a first offense
Up to $2,000, plus court costs.
License after a conviction
The suspension covers the whole driving privilege, a motorcycle class included. Under Transportation Code § 521.344 it runs 90 days to one year on a first conviction.
License after an arrest
An administrative suspension can begin on the 40th day after notice unless an ALR hearing is requested in time.
Crash with serious injury or death
Intoxication assault under Penal Code § 49.07 or intoxication manslaughter under § 49.08. Both are felonies. The DA's Office runs a dedicated Vehicular Crimes Unit of prosecutors and investigators that responds directly to crash scenes and handles intoxication manslaughter, intoxication assault and fatal hit and run cases.

A second DWI is a Class A misdemeanor with a 30 day minimum jail term, and a third is a felony. The first case sets the history that every later case is measured against.

Real Questions

What Do People Ask About A Motorcycle DWI In Texas?

Can an officer spot impairment just from the way a bike is ridden?

An officer can describe what was seen, but a motorcycle behaves differently from a car. It leans through turns, wobbles at walking pace and reacts to crosswinds and broken pavement. A report that lists a riding cue without the road surface, the weather and the traffic around it tells only part of the story. The dash and body camera video can show what the written account leaves out.

Does a helmet or riding gear matter to the roadside tests?

It can. The standardized tests ask for heel to toe walking, a one leg stand and eye tracking. Stiff boots, a heavy jacket, a visor and hours in the saddle all affect balance and the eyes. This is an example, not a real case: a rider in thick riding boots is told to balance on one leg on a gravel shoulder in the dark. The surface and the footwear are part of what a court weighs.

What if I refused the breath or blood test?

A refusal brings its own license consequence under Transportation Code Chapter 724, and it does not close the case. In Montgomery County, the No Refusal program runs on weekends, holidays and selected enforcement periods, publicized in advance. A driver who refuses a breath test does not end the testing. The officer contacts an on-duty prosecutor who drafts a blood search warrant, an on-call judge reviews it for probable cause, and if signed, blood is drawn by a nurse over the driver's objection. After a crash, hospital staff may also draw blood for medical care, and how that sample is obtained and used is a separate legal question.

What happens to the motorcycle after the arrest?

The bike is often towed, and storage fees add up each day. That is a practical problem apart from the charge. Sort out the tow paperwork, who may claim the motorcycle and whether a lender or insurer must be told. Do not repair damage before the evidence is looked at.

Can a crash change what the state has to prove?

Yes. When another person is seriously hurt, the state may add intoxication assault, and it must show the intoxication caused the injury. A fall that began with gravel, an animal, a car pulling out or a mechanical failure raises a cause question that a plain DWI does not have. See intoxication assault and intoxication manslaughter.

Possible Defenses

How Can A Motorcycle DWI Be Defended?

An attorney begins with what the officer saw and why the stop happened, then lines that account up against the video, the road and the rider. The state has to prove each element. No result can be promised.

Rider cases turn on conditions a car driver never faces: balance on two wheels, protective gear, a shoulder that is dark and uneven, and a crash that may have injured the rider before any test was given.

Cues and tests can be checked against the record.

The field sobriety tests follow a written protocol. Body camera and dash camera footage can show whether the officer followed it and whether the setting allowed a fair test.

A rider who went down may have a head injury, shock or pain that looks like impairment. Medical records can become part of what a court considers.

Why The Rider Was Stopped

Was there a lawful reason for the stop, and does the reported riding fit normal handling of a motorcycle?

Who Was Operating

Was the person operating the bike, or was it parked, pushed or stalled?

Balance And Gear

Did boots, a helmet, a jacket, an injury or the roadside surface skew the tests?

The Eye Exam

Could a visor, glasses, passing traffic or flashing lights have affected the eye test?

The Warrant Blood Draw

If blood was taken under a warrant, does the affidavit support probable cause, and were the draw and lab work sound?

Cause After A Crash

If a felony is charged, did the intoxication cause the injury, or did the road or another driver?

Local Process

What Happens After A Motorcycle DWI Arrest In Montgomery County?

Booking, bond and the license deadline follow Texas law across the state. The court, the prosecutor and the jail below are specific to Montgomery County.

  1. Booking And The Magistrate

After arrest, a person is booked and brought before a magistrate, who explains the charge and sets bond. Texas Code of Criminal Procedure article 15.17 sets the timing for that appearance.

  2. The 15 Day ALR Window

The request for an ALR hearing goes to the Texas Department of Public Safety, and the hearing is held by the State Office of Administrative Hearings. It is due within 15 days after the person receives the notice of suspension.

  3. Evidence Review

The defense can ask for the state's evidence, including video, reports and lab records, under Code of Criminal Procedure article 39.14. After a crash with injuries, the county's Vehicular Crimes Unit may already be involved.

  4. Resolution

The case can move toward dismissal, a reduction, a plea agreement, a program where one exists, or a trial. Which path is open depends on the evidence.

Where it is filed
A misdemeanor is filed in one of the Montgomery County Courts at Law and prosecuted by Montgomery County District Attorney's Office. A felony is heard in the district courts at the Montgomery County Criminal Justice Center on 207 W Phillips St, a different building, and prosecuted by the Montgomery County District Attorney's Office.
Who makes the arrest
Conroe Police Department, Montgomery County Sheriff's Office, Texas DPS Highway Patrol, Montgomery County Constables, Precincts 1 through 5, Willis Police Department, Shenandoah Police Department, Oak Ridge North Police Department, Magnolia Police Department, Splendora Police Department, or Roman Forest Police Department.
Where you are booked

Next Steps

What Should You Do After A Motorcycle DWI Arrest?

Some of the best evidence in a rider's case fades quickly. These steps are general information, not advice for any one person.

Count 15 Days

Find the date on the notice of suspension and ask about an ALR hearing before the deadline passes.

Keep The Gear

Keep the boots, jacket, helmet and eyewear from that night, and photograph them as they are.

Photograph The Scene

Take pictures of the road, the shoulder, the lighting and any damage in daylight, once it is safe to do so.

Save Medical Records

If you were hurt, keep every record from the hospital or clinic, because an injury can look like impairment.

Leave The Bike Alone

Hold off on repairs. Damage and mechanical problems can matter to how the stop or crash happened.

Stay Off Social Media

Do not post about the ride, the arrest or the case.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Conroe trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Motorcycle DWI Questions People In Conroe Ask

Does a motorcycle DWI in Conroe, TX carry different penalties than a car DWI?

Texas Penal Code § 49.04 applies to anyone operating a motor vehicle in a public place, and a motorcycle meets that definition. The classifications and ranges match a car DWI: a first offense is a Class B misdemeanor with 72 hours to 180 days in jail and a fine of up to $2,000. The differences sit in the evidence rather than in the penalty.

What riding cues do Montgomery County officers look for in a motorcycle DWI?

The National Highway Traffic Safety Administration published visual cues for spotting impaired riders. They include drifting during a turn or curve, trouble balancing at a stop, trouble dismounting, late braking or abrupt corrections in a turn, weaving, and inattention to surroundings. An arrest report may list these cues, and each one can be compared with the video and the road conditions.

Does a DWI on a motorcycle suspend a car license in Montgomery County?

A Texas suspension applies to the person's driving privilege, not to one vehicle or one class. A rider suspended after a DWI arrest or conviction loses the right to drive a car as well as the motorcycle. That holds for the administrative suspension through ALR and for a suspension that follows a conviction.

Who prosecutes a motorcycle crash with injuries in Montgomery County?

The Montgomery County District Attorney's Office runs a Vehicular Crimes Unit of prosecutors and investigators that responds to crash scenes and handles intoxication assault and intoxication manslaughter. Intoxication assault under Penal Code § 49.07 is a third degree felony, and intoxication manslaughter under § 49.08 is a second degree felony. A passenger on the bike counts as another person under both.

Can a rider in Conroe, TX be charged with DWI while sitting on a parked bike?

Texas courts read the word operating broadly, and it does not require the motorcycle to be moving at speed. Sitting astride a running bike, or taking steps to start it or put it in motion, has been argued as operation. Whether the engine was running, where the key was and where the bike was parked are facts the court weighs.

Do riding boots and gear affect field sobriety tests in Conroe, TX?

The standardized field sobriety tests ask a person to walk heel to toe, turn, and stand on one leg. A rider coming off a motorcycle may be wearing heavy boots, a jacket and protective gear, and may be tired from hours in the saddle. The testing manual describes conditions for a fair administration, and whether those were met is part of the record.
