Discharge Of A Firearm In A Municipality Lawyer In Beaumont, TX
Texas has no single charge for firing a gun in town. Depending on where the shot was fired and where it went, one trigger pull can be a fine-only ordinance case or a third degree felony, and this page explains each route and how the charges are defended.
What Is The Charge For Firing A Gun In A Texas City?
Texas has no one statute. A city may regulate discharge inside its limits by ordinance, and the Penal Code covers discharge in a public place, on a road, in a large city under § 42.12, or toward people and occupied places as deadly conduct. The range runs from a fine to a third degree felony.

Understanding Texas Law
How Does Texas Law Treat Firing A Gun In A City?
Texas splits control over gunfire inside cities between municipalities and the Penal Code, so several statutes can reach one shot. The size of the city and the path of the round both matter.
Under Local Government Code § 229.001, cities cannot regulate possession, carrying, transfer or storage of firearms, but they keep the power to regulate discharge inside their limits, other than at a sport shooting range. Chapter 229 also narrows how far those rules reach into annexed land and extraterritorial jurisdiction for certain weapons fired on larger tracts.
A shot fired on a rural lot near Nome or China may fall under no city ordinance at all, and then the state statutes carry the case.
Statutes that can apply to a single shot:
- A city discharge ordinance, heard in municipal court
- § 42.12, reckless discharge, in municipalities of 100,000 or more
- § 42.01(a)(7), discharge in a public place
- § 42.01(a)(9), discharge on or across a public road
- § 22.05, deadly conduct, when people or occupied places are at risk
A prosecutor may choose among overlapping statutes. Section 42.12 itself says conduct that violates it and another section can be prosecuted under either.

Penalties And Consequences
What Are The Penalties For Firing A Gun In A City In Texas?
Depending on the statute, the exposure runs from a fine up to ten years in prison. These are statutory limits, not predictions.
For § 42.01(a)(9), firing on or across a public road.
Disorderly conduct, firearm in a public place.
Third degree felony.
- City ordinance
- Fine only, set by the ordinance within state limits and heard in that city's municipal court.
- Disorderly conduct, (a)(7)
- Class B misdemeanor. Up to 180 days in jail and a $2,000 fine.
- Disorderly conduct, (a)(9)
- Class C misdemeanor. A fine up to $500.
- § 42.12, large cities only
- Class A misdemeanor. Up to one year in jail and a $4,000 fine.
- Deadly conduct, § 22.05(a)
- Class A misdemeanor, for reckless conduct placing another in imminent danger of serious bodily injury.
- Deadly conduct, § 22.05(b)
- Third degree felony, for knowingly firing at or toward people, or toward a habitation, building or vehicle while reckless about occupancy.
A felony conviction ends the right to possess a firearm. A round that damages property can also lead to a criminal mischief charge.

Possible Defenses
How Can A Firearm Discharge Charge Be Defended?
The gap between a Class B misdemeanor and a third degree felony often comes down to direction. An attorney reviews where the person stood, where the round went and who or what was nearby. No result can be promised.
Mental state is part of every statute on the list. The state must prove it beyond a reasonable doubt, and a knowing discharge is required for deadly conduct under (b).
Justification is part of the Penal Code as well.
Chapter 9 sets out when force or deadly force is justified, including in defense of self, others and property. When a shot answered a threat, those provisions shape what the state must disprove.
An arrest for a discharge can also raise whether the person could lawfully carry the weapon. See unlawful carrying of a weapon and, for public order charges, disorderly conduct.

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Firearm Discharge Questions People In Beaumont Ask
Is it illegal to fire a gun inside the city limits in Beaumont, TX?
Local Government Code § 229.001 bars cities from regulating most aspects of firearms but preserves a city's authority to regulate discharge inside its limits, other than at a sport shooting range. A city discharge ordinance is a fine-only offense heard in municipal court. State charges such as disorderly conduct or deadly conduct can apply anywhere.
Does Penal Code § 42.12 apply to a shot fired in Jefferson County?
Section 42.12 makes reckless discharge of a firearm a Class A misdemeanor only inside the limits of a municipality with a population of 100,000 or more. Whether it applies depends on the population of the city where the shot was fired. Where it does not apply, the state charges come from the disorderly conduct and deadly conduct statutes.
What is the charge for shooting toward a house or car in Beaumont, TX?
Knowingly discharging a firearm at or in the direction of a habitation, building or vehicle while reckless about whether it is occupied is deadly conduct under Penal Code § 22.05(b), a third degree felony carrying two to ten years in prison. Firing at or toward one or more people falls under the same subsection.
Is celebratory gunfire a crime in Jefferson County?
Firing into the air can be charged several ways. Discharging a firearm in a public place is Class B disorderly conduct under § 42.01(a)(7), and firing inside city limits can violate a city ordinance. If a round strikes property, criminal mischief can follow, and if someone is put in imminent danger of serious bodily injury, Class A deadly conduct under § 22.05(a) is available.
Who prosecutes a firearm discharge case in Beaumont, TX?
A city ordinance violation is prosecuted in that city's municipal court. State misdemeanors and felonies are prosecuted in the county courthouse, with felonies presented to a grand jury and then heard in a district court. The Jefferson County Criminal District Attorney's Office handles felony prosecutions.
Can self-defense be raised in a firearm discharge case in Beaumont, TX?
Chapter 9 of the Penal Code sets out when force or deadly force is justified, including defense of self, others and property. When some evidence shows a shot was fired in answer to a threat, the state has to disprove the justification beyond a reasonable doubt. The facts about the threat and the response decide whether it applies.
