Gavel, scales and handcuffs together, representing a group drug prosecution in felony court

Drug Conspiracy Lawyer In Beaumont, TX

A drug conspiracy charge in Texas rests on an agreement, not on a completed sale. A group case can also be filed as engaging in organized criminal activity, a separate offense graded on its own, and the same facts can reach federal court. This page covers what the state must prove, how the charges are graded, how they are defended and what happens after an arrest.

What Is Drug Conspiracy In Texas?

Drug conspiracy in Texas means agreeing with one or more people to commit a felony drug offense, with intent that it be carried out. Penal Code § 15.02 defines the offense, and Health and Safety Code § 481.108 drops the overt act requirement for drug cases. Prosecutors can also charge organized criminal activity under Penal Code § 71.02, which is graded separately.

Understanding Texas Law

How Does Texas Law Define Drug Conspiracy?

When several people are accused in one drug investigation, Texas prosecutors have two tools. Criminal conspiracy sits in Penal Code chapter 15. Engaging in organized criminal activity, called EOCA, sits in Penal Code § 71.02. They can look alike in an indictment, yet different rules grade them.

Conspiracy means an agreement between two or more people that a felony will be committed, plus the intent that it really be committed. For most offenses someone must also take a step toward carrying it out. In drug cases, Health and Safety Code § 481.108 applies the Penal Code's preparatory-offense rules to the Controlled Substances Act and drops that overt act requirement.

What a state drug conspiracy charge rests on:

  • An agreement with at least one other person to engage in conduct that is a felony
  • Intent by the accused that the felony be carried out
  • No completed delivery and no overt act, because § 481.108 removes that element

The agreement can be proven from circumstances instead of a written deal. Text threads, call logs, shared travel and money movement become the core evidence, so a conspiracy file can be mostly paper and data.

Penalties And Consequences

What Are The Penalties For Drug Conspiracy In Texas?

Conspiracy steps down from the offense it targets, while EOCA is graded under its own section. The state can file one, the other, or both on the same facts, so the charging document matters as much as the evidence. These are statutory rules, not predictions.

Criminal conspiracy, § 15.02(d)
One category below the most serious felony that was the object. A state jail felony object becomes a Class A misdemeanor.
Organized criminal activity, § 71.02
Graded under that section and not under the drug statute. Delivery and possession with intent to deliver are among the listed offenses.
Party liability, § 7.02(b)
If one conspirator commits a different felony while carrying out the plan, the others can answer for it when it should have been anticipated.
Federal conspiracy, 21 U.S.C. § 846
Carries the penalties of the drug offense it targets, including quantity-based mandatory minimums.

Conspiracy counts often arrive beside a drug distribution count. The tiers those counts rest on are on the penalty groups page.

Real Questions

What Do People Ask About Drug Conspiracy Charges In Texas?

Can I be charged just for being around people who sold drugs?

Presence is not an agreement. For example, a person who rides along to a friend's apartment and waits in the car has not necessarily agreed to anything. The state has to show an agreement and intent to carry out the felony, and being nearby does not prove either. This is an example, not a real case.

Does anyone have to actually sell drugs for a conspiracy charge?

No completed sale is required. Because § 481.108 removes the overt act element for drug cases, the agreement and the intent can be enough. The state still needs proof of both, drawn from messages, calls and what the people did.

What if a co-defendant is testifying against me?

Article 38.14 bars a conviction on an accomplice's testimony unless other evidence tends to connect the defendant to the offense. A cooperating witness may have been promised something, and any deal can be explored on cross-examination.

Can the same events be charged in state and federal court?

They can. A state and a federal prosecutor each have their own authority, and one investigation may produce a case in each. Federal conspiracy under § 846 is sentenced under very different rules than Texas offenses.

Possible Defenses

How Can A Drug Conspiracy Charge Be Defended?

Group cases depend on insiders and on records. An attorney reviews who made the statements, what the messages actually say, and whether the evidence shows an agreement by this person and not just activity around them. No result can be promised.

Art. 39.14 requires the state to disclose evidence that tends to negate guilt or impeach a witness, which can matter when a co-defendant has been offered a deal.

The corroboration has to point at the accused.

Evidence that a crime happened is not enough to satisfy art. 38.14. The other evidence must tend to connect this defendant to the offense.

Messages and call logs also need an author. Shared phones, borrowed numbers and group chats make it harder to say who wrote what, and a search of a phone generally needs a warrant.

The Intent

Decline Questions

You can ask for a lawyer and stop answering before an investigator or agent.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Drug Conspiracy Questions People In Beaumont Ask

What does the state have to prove for drug conspiracy in Beaumont, TX?

Penal Code § 15.02 requires proof that the person intended a felony to be committed and agreed with one or more people that they would engage in that conduct. For drug offenses, Health and Safety Code § 481.108 removes the overt act requirement that applies to other conspiracies. The agreement can be shown by circumstantial evidence, including how the people acted.

How is drug conspiracy graded in Jefferson County compared with the drug offense?

Under Penal Code § 15.02(d), conspiracy is punished one category below the most serious felony that was its object. If the object was a state jail felony, the conspiracy is a Class A misdemeanor. Organized criminal activity under § 71.02 is a different offense with its own grading, so the label the state chooses changes the range.

What is a combination in an organized criminal activity case in Beaumont, TX?

Section 71.02 applies when a person commits or conspires to commit a listed offense, which includes manufacture or delivery of a controlled substance, with intent to establish, maintain or take part in a combination or its profits. A combination is three or more people who collaborate in carrying on criminal activities. Gang membership is a separate route to the same offense.

Can someone be charged with drug conspiracy in Jefferson County without handling drugs?

The offense rests on the agreement and the intent that a felony be carried out, so physical possession is not an element. It is also no defense that a co-conspirator was acquitted or never prosecuted. The state still has to prove that the accused agreed and intended the felony as an individual, and presence alone does not prove either.

When is a drug conspiracy near Beaumont charged in federal court?

Federal prosecutors charge drug conspiracy under 21 U.S.C. § 846, which carries the penalties of the underlying offense, including quantity-based mandatory minimums. No overt act is required. Federal cases from this area are filed in the Eastern District of Texas, Beaumont Division, and the same events can produce both a state and a federal case.
