Which Drugs Lead To A DWI Charge In Beaumont, TX

Texas does not keep a list of drugs that count for DWI. The statute reaches any substance that takes away the normal use of mental or physical faculties, which includes things bought without a prescription, and this page walks through the seven groups evaluators use and how the state must tie a substance to the driving.

Which Drugs Can Lead To A DWI Charge In Texas?

Any drug, prescribed or bought off the shelf, can support a Texas DWI charge when the state says it took away the normal use of mental or physical faculties. Penal Code § 49.01 lists alcohol, controlled substances, drugs, dangerous drugs, combinations and any other substance. Officers are trained to sort the signs into seven drug categories.

Understanding Texas Law

Which Drugs Can Support A DWI Charge In Texas?

A Texas DWI does not depend on the type of drug. Penal Code § 49.01(2) defines intoxicated as not having the normal use of mental or physical faculties because of alcohol, a controlled substance, a drug, a dangerous drug, a combination of those, or any other substance introduced into the body.

Three terms in that sentence do different work. A controlled substance is something scheduled under the Texas Controlled Substances Act. A dangerous drug is a prescription medicine that is not scheduled. The phrase "any other substance" is the catch-all, and it is what lets a drugstore product support a charge.

The substance does not change the offense level or the punishment range. It changes the proof. With no breath number to point to, the state builds a drug case from the driving, an officer's observations, sometimes a drug recognition evaluation, and a toxicology report.

The seven groups in drug recognition training:

  • Central nervous system depressants
  • Central nervous system stimulants
  • Hallucinogens
  • Dissociative anesthetics
  • Narcotic analgesics
  • Inhalants
  • Cannabis

Everyday medicines are sorted into these groups by how they act on the body. A muscle relaxant or a sedating antihistamine is treated as a depressant, and a prescription painkiller as a narcotic analgesic.

The general rules for how drug cases are charged and tested are on the drug DWI overview.

Penalties And Substance By Substance

What Drugs Show Up In DWI Cases, And What Is The Penalty?

The penalty for a drug related DWI comes from the DWI statute, not from the substance. A first offense carries the same range whether the state alleges alcohol, a prescription or an illegal drug, and priors or aggravating facts raise it. The table describes each group and what an evaluator is trained to note. It does not say what any lab result means for a particular driver.

7
Drug categories officers are trained to evaluate
72 hrs to 180 days
Jail range for a first DWI

The same whatever substance is alleged.

$2,000
Maximum fine for a first DWI

Class B misdemeanor under Penal Code § 49.04.

Depressants
Benzodiazepines such as alprazolam and diazepam, barbiturates and GHB. Evaluators note slurred speech, poor coordination and nystagmus, an involuntary jerking of the eyes.
Sleep aids
Prescription products such as zolpidem and eszopiclone, plus over the counter sleep tablets. They act as depressants and are evaluated as such.
Muscle relaxants
Carisoprodol and cyclobenzaprine are common examples. Both are sedating and are placed with the depressants.
Antihistamines
First generation products such as diphenhydramine and doxylamine, found in allergy, cold and nighttime formulas.
Opioids
Hydrocodone, oxycodone, morphine, codeine, fentanyl, methadone and heroin. Evaluators look for small pupils, drooping eyelids and slow reactions.
Stimulants
Methamphetamine, cocaine and prescription amphetamines used for attention disorders.
Cannabis
Marijuana and THC products. Evaluators note bloodshot eyes, a lack of convergence and trouble with divided attention tasks.
Dissociatives
PCP, ketamine and dextromethorphan at high doses.
Hallucinogens and inhalants
LSD, psilocybin and MDMA fall under hallucinogens. Inhalants include aerosols and solvents.
Combinations
Alcohol with any of the above, or two drugs together, which § 49.01(2) covers expressly.

Prior convictions work the same way for every substance. A second DWI is a Class A misdemeanor and a third is a felony, and Texas sets no lookback period.

Real Questions

What Do People Ask About Drugs And DWI In Texas?

Does a valid prescription protect a driver?

Not by itself. Penal Code § 49.10 says it is not a defense that a person was entitled to use the substance, so a medicine taken as directed can still support a charge. The state has to show the medicine caused a loss of normal use of faculties while driving. The prescription drug DWI page covers how that rule works.

Does a positive blood test prove impairment?

It proves presence. A lab report answers whether a substance or a breakdown product was in the sample, not how much was in the body while driving or whether that amount affected the person. Some substances leave inactive traces long after any effect has ended.

What about two products that are each legal?

For example, a driver finishing a night shift takes a nighttime cold tablet before leaving work and a prescribed muscle relaxant an hour earlier, then is stopped on the way home. Neither product is unlawful. The state could still allege that the combination left the driver without normal faculties, and the dose times and the stop would be central facts. This is an example, not a real case.

Is marijuana treated differently from other drugs?

Cannabis is one of the seven groups, and the same loss of faculties standard applies. THC metabolites can stay in blood after the effects have passed, so a result alone does not answer the timing question. The marijuana DWI and THC, Delta-8 and CBD DWI pages cover those cases.

Can a drug found in the car add another charge?

A controlled substance found in the vehicle can bring a separate drug possession charge on top of the DWI. The two charges rest on different elements and are defended differently.

Possible Defenses

How Can A Drug DWI Charge Be Defended?

With no numeric limit for drugs, the state cannot win by pointing to a lab figure. It has to connect a substance in the body, a loss of normal use of faculties and the driving. An attorney reviews the file to see where those links are strong and where they are thin. No result can be promised.

Whether a substance is lawful does not settle the case in either direction. Section 49.10 means a prescription is no defense by itself, and an illegal drug found in a sample is not proof of impairment on its own.

How the substance group meets the evidence:

  • Depressant and opioid signs overlap with fatigue and illness
  • Stimulant signs can resemble nerves during a roadside stop
  • Cannabis metabolites can stay in the blood after any effect has ended
  • Two substances at once make it hard to say which one caused a given sign

Each point is a fact about how the evidence works, not a conclusion about any case.

Local Process

What Happens After A Drug DWI Arrest In Jefferson County?

Each step below comes from state law. The agency that investigates, the court that receives the case and the booking are what belong to Jefferson County.

  1. The Stop And The Evaluation

After a stop, the officer may use field tests and may call a drug recognition evaluator, who works through a written protocol and forms an opinion on a drug group.

  2. The Specimen

Breath instruments measure alcohol, so a drug case rests on blood or urine, taken by consent, by warrant or under an exception and sent to a lab.

  3. The 15 Day License Window

An ALR request goes to DPS within 15 days after the notice of suspension is received, whether or not lab results are back.

  4. Charging And Discovery

When results return, the prosecutor files charges, and the defense requests the full lab file, the video and the evaluation records.

Where it is filed
A misdemeanor is filed in one of the Jefferson County Courts at Law. A felony is heard in the district courts at the Jefferson County Courthouse on 1085 Pearl Street, with the Jefferson County Criminal District Attorney's Office prosecuting.
Who investigates
Beaumont Police Department, Jefferson County Sheriff's Office, Texas DPS Highway Patrol, Port Arthur Police Department, Nederland Police Department, Port Neches Police Department, or Groves Police Department.
Booking
Arrestees from every law enforcement agency in the county are booked into the county's jail system.
License hearing
The State Office of Administrative Hearings, requested through DPS.
If the case is appealed
the Ninth Court of Appeals in Beaumont.

The drug DWI overview explains the charge in full, and the page on field sobriety and breath tests covers the roadside tests that come before any lab work.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Drug And DWI Questions People In Beaumont Ask

Can a cold or allergy medicine lead to a DWI in Beaumont, TX?

Penal Code § 49.01(2) covers a drug, a dangerous drug, a controlled substance or any other substance introduced into the body. A sedating antihistamine in a nighttime cold product fits that wording. The state still has to prove the substance caused a loss of normal use of mental or physical faculties while the person was driving.

Does alcohol plus a medication count as intoxication in Jefferson County?

The statutory definition names a combination of two or more substances. A case can rest on alcohol and a drug together even when the alcohol concentration is under 0.08. The state then relies on the loss of normal use standard and has to connect the combination to the driving it describes.

What categories does a drug recognition expert use in a Beaumont DWI stop?

Drug recognition training sorts substances into seven categories: central nervous system depressants, central nervous system stimulants, hallucinogens, dissociative anesthetics, narcotic analgesics, inhalants and cannabis. The evaluator's opinion names one or more of them. Laboratory testing of blood or urine is the step that checks the opinion against what was found.

Can a sleep medication cause a DWI arrest in Beaumont, TX?

Sleep medications such as zolpidem, and over the counter products built on diphenhydramine or doxylamine, are sedating by design. A driver stopped while one is active can be charged under the loss of normal use standard. The timing of the dose and the timing of the drive are central facts in those files.

Do stimulants show up in Jefferson County DWI cases?

Methamphetamine, cocaine and prescription amphetamines all appear in Texas DWI files. The signs an officer attributes to a stimulant differ from depressant signs and include a raised pulse, dilated pupils and restlessness. Those observations are weighed against the lab report and the timeline of the stop.

Can a drug taken days before driving support a charge in Beaumont, TX?

Presence of a substance in a sample is not the offense. The state has to show a loss of normal use of faculties from a substance at the time of driving. Some drugs leave inactive traces long after any effect has ended, which is why the timing and the lab method are part of the file.
