Intoxication Manslaughter Lawyer In Beaumont, TX
Intoxication manslaughter is the most serious DWI offense in Texas. It carries up to twenty years in prison, and in Jefferson County it is heard in a district court at the county courthouse. This page covers the elements, the sentencing rules, how these cases are defended and what to do first.
What Is Intoxication Manslaughter In Texas?
Intoxication manslaughter is causing another person's death, by accident or mistake, while operating a vehicle while intoxicated. Penal Code § 49.08 makes it a second degree felony and requires no proof of intent. The death must result from the intoxication. A judge cannot grant probation, and deferred adjudication is barred by statute.
Understanding Texas Law
How Does Texas Law Define Intoxication Manslaughter?
Penal Code § 49.08 makes it a felony of the second degree to cause another person's death, by accident or mistake, while operating a motor vehicle in a public place while intoxicated. Aircraft, watercraft and amusement rides fall under the same section.
No intent, knowledge or recklessness has to be proven, because § 49.11 removes the mental state from intoxication offenses. That separates this charge from manslaughter under § 19.04, which requires recklessness.
Causation is where the state cannot skip a step. The death has to result from the intoxication, and the concurrent cause rule in § 6.04 applies here as it does to intoxication assault.
Four elements under § 49.08:
- Operation of a motor vehicle in a public place, or an aircraft, watercraft or amusement ride
- Intoxication at that time
- The death of another person
- Death caused by reason of the intoxication
Each person killed can be charged as a separate count. A crash that kills one person and seriously injures another can bring both charges in one indictment.
A fatal crash with no intoxication alleged falls under different statutes, covered on the vehicular manslaughter page.

Penalties And Consequences
What Are The Penalties For Intoxication Manslaughter In Texas?
The range is set by § 49.08, and several sentencing rules attach to this offense that apply to no other DWI charge. These are statutory limits, not predictions.
A judge cannot grant probation at all.
- Classification
- Second degree felony: two to twenty years in prison, fine up to $10,000.
- Probation
- A judge cannot grant it under Code of Criminal Procedure art. 42A.054. A jury can recommend it for a sentence of ten years or less.
- Deferred adjudication
- Barred by art. 42A.102.
- More than one count
- Sentences can be ordered to run consecutively under Penal Code § 3.03(b).
- Child support restitution
- Ordered under art. 42.0375 when the person killed was the parent or guardian of a minor child.
- Bond
- An ignition interlock under art. 17.441 unless the magistrate finds it not in the interest of justice.
A conviction changes every later DWI as well. Under § 49.09(b)(1), a single prior intoxication manslaughter conviction makes any future DWI a felony DWI.

Possible Defenses
How Can Intoxication Manslaughter Be Defended?
A fatal crash file holds intoxication evidence, crash evidence and cause of death evidence. The state has to carry all three, and an attorney examines each separately. No result can be promised.
- Intoxication: when blood was drawn, under what warrant or exception, and what the lab data shows
- The crash: reconstruction, event data recorder downloads, lighting, road conditions and the other vehicle's movements
- The death: the autopsy, the medical care after the crash and the time between the two
Evidence fades on its own schedule.
Vehicles are salvaged, vehicle data is overwritten and the scene changes. An independent look at the same vehicles and roadway is possible only while they still exist.
The criminal case may not be the only case, since a death can also bring a wrongful death suit. The DWI court process page explains how evidence is requested and challenged before trial.

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Intoxication Manslaughter Questions People In Beaumont Ask
What is the difference between manslaughter and intoxication manslaughter in Beaumont, TX?
Manslaughter under Penal Code § 19.04 requires proof that a person recklessly caused a death. Intoxication manslaughter under § 49.08 requires no mental state. The state must prove operation of a vehicle while intoxicated and a death caused by that intoxication. Both are second degree felonies at the base level, with different elements and different sentencing rules.
Who prosecutes intoxication manslaughter in Jefferson County?
The Jefferson County Criminal District Attorney's Office prosecutes felonies in the county, including intoxication manslaughter. The case is presented to a grand jury, and an indictment sends it to a district court. The prosecutor's office, the district clerk and the courts are all in the courthouse on Pearl Street.
What is the sentence range for intoxication manslaughter in Beaumont?
At its base level it is a second degree felony: two to twenty years in prison and a fine up to $10,000. Each person killed can be charged as a separate count, and under Penal Code § 3.03(b) sentences for the same criminal episode can be ordered to run consecutively, which is a decision for the court.
Can a judge grant probation for intoxication manslaughter in Jefferson County?
Code of Criminal Procedure art. 42A.054 does not allow a judge to grant community supervision for intoxication manslaughter. A jury can recommend it when the prison sentence it assesses is ten years or less. Deferred adjudication is barred outright under art. 42A.102.
What is Bentley's Law in an intoxication manslaughter case in Beaumont, TX?
Bentley's Law is Code of Criminal Procedure art. 42.0375, added by House Bill 393 in 2023. When a person is convicted of intoxication manslaughter and the person killed was the parent or guardian of a child, the court orders restitution for that child's support. The statute sets the duration and the payment process.
