Officer handcuffing a person beside a vehicle, the kind of arrest that can follow a BWI contact on the water

Boating While Intoxicated Lawyer In Beaumont, TX

Boating while intoxicated sits in the same chapter of the Penal Code as DWI and carries the same first offense range, even though the arrest may come from a game warden instead of a patrol officer. This page covers what the state must prove on the water, the penalties, the license case that can follow and how a BWI is defended.

The driver's license is part of this case. A failed or refused breath or blood test after a BWI arrest can start the same license suspension process as a DWI. The request for an ALR hearing is due within 15 days after you receive the notice of suspension.

What Is Boating While Intoxicated In Texas?

Boating while intoxicated is operating a watercraft while intoxicated, an offense under Penal Code § 49.06. Intoxicated means a 0.08 alcohol concentration or loss of the normal use of mental or physical faculties from alcohol, a drug or another substance. A first offense is a Class B misdemeanor with a 72 hour jail minimum, and the statute does not require a public place.

Understanding Texas Law

How Does Texas Law Define Boating While Intoxicated?

Penal Code § 49.06 makes it an offense to operate a watercraft while intoxicated. The word intoxicated carries the meaning it has in § 49.01 for every offense in the chapter: a 0.08 alcohol concentration, or loss of the normal use of mental or physical faculties from alcohol, a drug or a combination.

A DWI requires a public place, and BWI does not. The element that matters on the water is operation of a watercraft. Section 49.01 defines one as a vessel, one or more water skis, an aquaplane, or another device that carries a person on water, other than a device moved only by the current. A bass boat, a ski boat and a personal watercraft all fit.

Having a drink aboard is not the offense. The charge falls on whoever was operating, and operation is an element the state must prove right alongside intoxication.

What the state has to prove in a BWI case:

  • The person charged was operating a watercraft
  • The operation took place in Jefferson County
  • The person was intoxicated, by a 0.08 concentration or loss of normal faculties

A separate statute, § 49.061, took effect September 1, 2023. It punishes operating a watercraft while intoxicated with a passenger younger than 15, and the offense is a state jail felony.

When someone is hurt or killed, the charge can become intoxication assault or intoxication manslaughter. Both statutes reach watercraft as well as motor vehicles.

Penalties And Consequences

What Are The Penalties For Boating While Intoxicated In Texas?

BWI follows the penalty structure of DWI, and the enhancement rules run across the whole chapter. These are the limits the statutes allow, not predictions for any case.

72 hrs to 180 days
Jail range for a first BWI
$2,000
Maximum fine for a first BWI

Plus court costs.

30 days
Minimum jail with one prior

The offense becomes a Class A misdemeanor.

State jail felony
BWI with a passenger under 15

Charged under § 49.061.

Classification
Class B misdemeanor (§ 49.06).
Jail
72 hours minimum, up to 180 days.
Fine
Up to $2,000, plus court costs.
With one prior intoxication conviction
Class A misdemeanor with a 30 day minimum (§ 49.09(a)).
With two priors
Third degree felony (§ 49.09(b)). Prior DWI, BWI and flying while intoxicated convictions all count.
With a passenger under 15
State jail felony (§ 49.061).
Probation
Community supervision can be ordered in place of some or all of the jail time, with conditions the judge sets.
Driver's license
A failed test or refusal after a BWI arrest can start the ALR process, with 15 days to request a hearing before the State Office of Administrative Hearings.

Because § 49.09 sets no lookback period and counts a BWI the same as a DWI, a boating arrest can raise the level of a driving charge years later. That is a reason a first BWI deserves a careful review.

Real Questions

What Do People Ask About Boating While Intoxicated In Texas?

Who counts as the operator when several people share a boat?

It depends on who had control. For example, the owner of a bay boat hands the wheel to a friend at the ramp, then takes it back in open water after an hour. Which of the two was operating at the moment of the contact, and what the evidence shows about it, would be central facts. The statute reaches the operator, not every passenger. This is an example, not a real case.

Can I be asked for a breath or blood sample on the water?

Texas implied consent law covers watercraft, so a person arrested for BWI is treated as having consented to a specimen, subject to chapter 724. A refusal does not end the matter, because an officer can seek a warrant. The refusal itself can start a license suspension and may be offered at trial.

Does the refusal hearing treat every boat the same way?

Not necessarily. Transportation Code § 724.042, which lists the issues at a refusal hearing, refers to a watercraft powered by an engine rated at 50 horsepower or more. Whether that wording applies depends on the boat and the facts, and a lawyer checks it in the file.

Will a BWI show up on a background check?

A conviction is a public criminal record that employers, landlords and licensing boards can find, and it counts as a prior intoxication offense for later cases. A case that ends in dismissal or acquittal can often be cleared through an expunction, and some outcomes may qualify for nondisclosure.

Possible Defenses

How Can A Boating While Intoxicated Charge Be Defended?

A BWI case is built from the contact on the water, the officer's observations and the chemical test, and each piece can be examined. An attorney reviews them to see what the state can prove. No result can be promised.

The first question is often who was operating, since the statute reaches the person at the controls. The second is whether the evidence of intoxication was gathered fairly, given how different a deck or a boat ramp is from a roadside.

A deck is not a roadside.

A BWI contact can begin with a safety equipment or registration check, and the questioning may take place on a moving deck, at a dock or on a ramp. The standardized field sobriety tests were designed and studied on level, dry ground. A person coming off the water after hours of sun, wind and motion is doing balance tests under very different conditions.

Where the tests were given, how soon after leaving the boat, and what any patrol boat or body camera video shows are all part of the record.

Next Steps

What Should You Do After A Boating While Intoxicated Arrest?

A BWI opens a criminal case and, often, a license case on the same day. These steps are general information, not advice for any one person.

Count 15 Days

Find the date on the notice of suspension and count 15 days from receiving it.

Keep The Paperwork

Save the citation, the notice, the bond papers and any test paperwork.

Write Down The Helm

Note who was steering, who owned the boat and how the controls changed hands during the day.

Record The Conditions

Note the heat, the wind, the water and the footing where any tests were given.

Save Photos And Video

Keep pictures or video from the trip, including any taken by passengers.

Stay Off Social Media

Do not post about the trip, the arrest or the case.

Talk to a lawyer before deciding how to proceed. A BWI can look minor because no car was involved, yet it counts as a prior intoxication offense and can reach a driver's license. Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Boating While Intoxicated Questions People In Beaumont Ask

What is the penalty for boating while intoxicated in Beaumont, TX?

Under Penal Code § 49.06, BWI is a Class B misdemeanor with a minimum of 72 hours in jail, a maximum of 180 days and a fine of up to $2,000. Under § 49.09, one prior intoxication conviction makes it a Class A misdemeanor with a 30 day minimum, and two priors make it a third degree felony. Those are statutory limits, not a forecast for one case.

Can a BWI arrest in Jefferson County affect a driver's license?

Texas implied consent law in Transportation Code chapter 724 covers a person arrested for operating a watercraft while intoxicated. Refusing a specimen, or giving one at 0.08 or more, can start the same administrative suspension that follows a DWI arrest. The request for an ALR hearing is due within 15 days after the notice is received.

Who makes BWI arrests near Beaumont, TX?

Texas Parks and Wildlife Department game wardens are state peace officers who enforce boating laws on public waters. Local agencies with jurisdiction over the water, such as the Sheriff's Office and city police departments, can make BWI arrests too. The person is then booked into the county jail system and the case goes to the county's prosecutors.

Does a kayak or jet ski count as a watercraft for BWI in Jefferson County?

Penal Code § 49.01 defines a watercraft as a vessel, one or more water skis, an aquaplane, or another device used for transporting or carrying a person on water, other than a device propelled only by the current of the water. A jet ski is a vessel. A kayak or paddleboard falls inside or outside the definition depending on how it is built and moved.

Does a BWI conviction count as a prior for a later DWI in Beaumont?

Penal Code § 49.09 counts a prior conviction for operating a watercraft while intoxicated the same way it counts a prior DWI. A BWI conviction can raise a later DWI to a Class A misdemeanor, and two priors of the kinds listed can make a later charge a third degree felony. Texas sets no time limit on those priors.

What if a child was aboard during a BWI arrest in Beaumont, TX?

Since September 1, 2023, Penal Code § 49.061 makes it a state jail felony to operate a watercraft while intoxicated with a passenger younger than 15. The charge is separate from ordinary BWI. A felony of that kind is heard in a district court rather than a county court at law.
