Mental Health Counselor License DWI Lawyer In Beaumont, TX
Licensed Professional Counselors and LPC Associates are regulated through the Texas Behavioral Health Executive Council. After a DWI, the Council's reporting rule asks what the case produced, not only whether an arrest happened, and this page explains the trigger, the timing and how the defense fits around it.
What Must A Texas Counselor Report After A DWI?
A Texas LPC or LPC Associate reports to the Behavioral Health Executive Council under 22 TAC § 884.32, which calls for a written report within 30 days of a conviction, sentence, dispositive agreement, or an order of community supervision or pretrial diversion. An arrest alone is not a listed event. The underlying charge is DWI under Penal Code § 49.04.

Understanding Texas Law
How Does The Behavioral Health Executive Council Handle An LPC's DWI?
A professional counselor in Texas holds a license from the Texas State Board of Examiners of Professional Counselors. Since the Texas Behavioral Health Executive Council was formed, that board has operated under it, and the Council writes the rules and handles enforcement for several mental health professions at once.
The rule that matters after a DWI is 22 TAC § 884.32. It makes the licensee responsible for a written report within 30 days of certain events. A conviction, a sentence, a dispositive agreement and an order of community supervision or pretrial diversion are on its list.
An arrest is not on that list. A counselor whose case is still open, or who gets a dismissal with no agreement, has no listed event to report. A plea or a diversion order starts the clock.
Events that start the 30 day report:
- A conviction or a sentence
- A dispositive agreement that resolves the charge
- An order placing the licensee on community supervision, which includes deferred adjudication
- An order of pretrial diversion
The report includes the case number, the court, the county and a description of the matter.
The general Occupations Code framework for licensed occupations is explained on the professional license DWI page.

Penalties And Consequences
What Are The Penalties And License Consequences For A Counselor's DWI?
Two different sets of consequences can follow a counselor's arrest. The court applies the ordinary DWI range, while the licensing side depends on what the case produces. Everything below is a statutory limit or a reporting rule, not a forecast.
Counted from the reportable event under 22 TAC § 884.32.
Fine of up to $2,000.
Under Transportation Code § 521.344.
- The charge
- Driving while intoxicated under Penal Code § 49.04. Class B on a first offense, Class A at 0.15 or higher.
- Jail range
- 72 hours to 180 days at Class B, up to one year at Class A.
- Licensing body
- The Texas State Board of Examiners of Professional Counselors, under the Behavioral Health Executive Council.
- Reporting rule
- 22 TAC § 884.32, a written report within 30 days of a listed event.
- Arrest alone
- Not a listed event under the rule.
- Pretrial diversion
- Listed as reportable, even though it can avoid a conviction.
- How a conviction is reviewed
- Chapter 53 asks whether the offense directly relates to the occupation, then weighs rehabilitation, time elapsed and work history (Occupations Code §§ 53.022 and 53.023).
- Eligibility rule
- 22 TAC § 882.42 covers ineligibility due to criminal history.
Because the reporting rule keys off the result, how the case ends decides what reaches the Council and when. A dismissal without any agreement is outside the list. A plea, a deferred order or a diversion agreement is on it.

What Do Counselors Ask About A DWI In Texas?

Possible Defenses
How Can A Counselor's DWI Be Defended?
The criminal defense starts with the evidence, the same as for any first DWI. An attorney reviews the stop, the roadside tests, the breath or blood result and the video to see what the state can prove. No result can be promised.
The license side adds a second question: which resolution, if any, would be reportable under Rule 884.32, and what does that mean for the counselor's work.
When the work is substance use and mental health.
Many counselors treat substance use as part of their caseload, and some supervise associates. An alcohol charge therefore sits nearer the center of the profession than it would for most occupations.
That closeness affects how a report is read, not whether a counseling career can continue. The Council looks at the facts against the licensee's own role: the test number, a refusal, a crash and any earlier arrests. Seeking an evaluation after an arrest is a clinical and personal choice that also creates records, so its timing relative to the criminal case is part of planning.
The Stop
What gave the officer a lawful reason to stop or detain the driver?
The Test
Was the breath or blood sample collected and analyzed correctly?
Which Resolution
Would dismissal, a plea, a deferred order or diversion trigger the report?
The Timing
When would the 30 day report fall due under each possible ending?
The Report Itself
Does the description stay with the court documents and nothing more?
Later Relief
Could the case end in a way that opens expunction or nondisclosure?
Local Process
What Happens After A Counselor's DWI Arrest In Jefferson County?
The criminal process and the Council's rules follow state law. The court, the prosecutor and the booking are the parts specific to Jefferson County.
Arrest And Booking
The person is booked into the county jail system and brought before a magistrate, who sets bond.
The ALR Window
A request for an ALR hearing goes to DPS within 15 days after the notice of suspension is received.
The Criminal Case
The defense requests the state's evidence and tests it. The case resolves by dismissal, a plea, a deferred order, a diversion agreement or trial.
The Council Report
If a reportable event occurs, the written report is due within 30 days and is worded from the court documents.
- Where the case is filed
- Filed in one of the Jefferson County Courts at Law and heard from the Jefferson County Courthouse on 1085 Pearl Street.
- Prosecution
- prosecutors in Jefferson County.
- Arresting agencies
- Beaumont Police Department, Jefferson County Sheriff's Office, Texas DPS Highway Patrol, Port Arthur Police Department, Nederland Police Department, Port Neches Police Department, and Groves Police Department.
- Booking
- Arrestees from every law enforcement agency in the county are booked into the county's jail system.
- License hearing
- The State Office of Administrative Hearings, requested through DPS.
- If the case is appealed
- the Ninth Court of Appeals in Beaumont.
Pretrial diversion, a deferred adjudication and a conviction each appear on the rule's list, and an outright dismissal does not. Later relief changes who can see the court record, not what has already been filed with the Council. A dismissal can support an expunction, and some outcomes qualify for a nondisclosure order. The ALR hearing page covers the driving side.
Next Steps
What Should A Counselor Do After A DWI Arrest?
A counselor's early choices set both the criminal defense and the later report. These steps are general information, not advice for any one person.
Count 15 Days
Find the date on the notice of suspension and count 15 days from receiving it.
Read Your Own Forms
Read renewal, employer and insurance panel questions word by word, since some ask about arrests.
Track Every Order
Note the date of any plea, sentence, supervision or diversion order, because the 30 days run from it.
Keep Reports Short
When a report is due, stay with the case number, the court, the county and a plain description.
Think About Clients
Consider how a pending case affects client notices and supervision duties, and ask before changing a caseload.
Keep Every Paper
Save the citation, the bond papers and every court document, since the report is built from them.
Talk to a lawyer before deciding what to plead to or when to report. A plea or an early statement cannot be taken back. Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Counselor License DWI Questions People In Beaumont Ask
What does an LPC have to report after a DWI in Beaumont, TX?
The Behavioral Health Executive Council's rule on reportable legal action, 22 TAC § 884.32, calls for a written report within 30 days of a conviction, sentence, dispositive agreement, or an order of community supervision or pretrial diversion. The report carries the case number, the court and the county. An arrest alone is not among the listed events.
Which agency licenses professional counselors who are charged in Jefferson County?
The Texas State Board of Examiners of Professional Counselors issues the license, and it sits under the Texas Behavioral Health Executive Council. The Council also oversees marriage and family therapists, psychologists and social workers, and it writes rules shared across those professions, including its criminal history provisions.
Is pretrial diversion for a Beaumont DWI reportable by a counselor?
Rule 884.32 names an order of pretrial diversion alongside convictions and community supervision. Diversion can keep a conviction from entering the record and may open the door to an expunction later, but under the Council's rule it still counts as a reportable event on the licensee's side.
What goes into a counselor's report of a DWI case in Beaumont, TX?
The rule asks for the case number, the court, and the county where the matter was filed, plus a description of what is being reported. The Council may also ask for court documents. Because the description enters the licensee's regulatory file, it is written from the actual orders and judgment in the case.
How does the Council decide whether a Jefferson County DWI matters to a license?
Occupations Code chapter 53 lets a licensing authority act on a conviction that directly relates to the duties of the occupation. It lists factors such as the nature of the crime and its link to the license, and then weighs the time that has passed, rehabilitation and work history. How that review applies to a counseling license is a question for the Council's rules.
Does a DWI in Beaumont affect an LPC Associate moving to a full license?
An associate is licensed by the same board and falls under the same Council rules on reporting and criminal history. When the Council evaluates a license application, 22 TAC § 882.42 addresses ineligibility due to criminal history, so the way the DWI case ended is part of what the Council can review.
