Drug Crime Enhancements Lawyer In Beaumont, TX
An enhancement does not change what a person is accused of doing. It changes the range of punishment attached to it. In a Texas drug case, the location, a weapon, a prior record or a group can each lift the same facts up a level, and this page covers how each works and how it can be challenged.
What Is A Drug Crime Enhancement In Texas?
A drug crime enhancement is a fact the state alleges to raise the punishment range for a drug offense. Health and Safety Code § 481.134 covers drug-free zones. Penal Code § 12.42 covers prior convictions, and a deadly weapon finding can raise or restrict punishment too. The state must plead and prove each one.

Understanding Texas Law
How Does The Texas Drug-Free Zone Law Work?
Health and Safety Code § 481.134 is the enhancement written for drug cases. It increases punishment for certain drug offenses committed in, on or near places the Legislature chose to protect, and the finding is made at the punishment phase.
Distances run from the premises, not from a door of a building. The statute defines a school to include a public or private elementary or secondary school and a day-care center. A playground is an outdoor, publicly open facility with three or more play stations for children. A 1,000-foot circle can take in much of a residential block in a city like Beaumont or a town like Port Arthur.
The places § 481.134 covers:
- Within 1,000 feet of school premises, an institution of higher learning, a youth center or a playground
- Within 300 feet of a public swimming pool or a video arcade facility
- In or on a school bus
A person with a prior zone-enhanced conviction is not eligible for community supervision on a new zone-enhanced conviction under Code of Criminal Procedure chapter 42A.

Possible Defenses
How Can A Drug Enhancement Be Defended?
An enhancement is its own set of facts, and each can be tested. An attorney checks the maps and measurements, the judgments behind a prior, and the evidence of how any weapon was used. No result can be promised.
A prior conviction has to be proven final and tied to the accused. A zone allegation needs a measured distance to a place that meets the statutory definition.
Why enhancements reach past the sentence.
A deadly weapon finding places an offense among the 3g offenses, which affects probation eligibility and the timing of parole. A prior-conviction enhancement can turn a probation-eligible charge into one with a prison minimum.
Weapons can also lead to separate charges, covered on the unlawful carrying of a weapon page.
The Measurement
Was the distance measured properly, and from the correct property line?
The Premises
Does the place meet the statute's definition of a school, youth center or playground?
The Prior
Is the old conviction final, and is it really this person's?
The Weapon
Was a weapon actually used or exhibited, or only present?
The Sequence
For two priors, did the second conviction follow the first as the statute requires?
The Pleading
Was the enhancement properly alleged before trial?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

- Break down complex chemical evidence in plain language for juries

Common Questions
Drug Enhancement Questions People In Beaumont Ask
What counts as a drug-free zone in Beaumont, TX?
Health and Safety Code § 481.134 covers offenses in, on or within 1,000 feet of school premises, an institution of higher learning, a youth center or a playground, within 300 feet of a public swimming pool or video arcade facility, and on a school bus. Because the distances run from property lines, a wide area around each qualifying place is covered.
How much can a drug-free zone raise a charge in Jefferson County?
For the offenses listed in § 481.134, a finding at the punishment phase that the offense occurred in a zone moves the charge up one degree of felony. A state jail felony becomes a third degree felony, a third degree becomes a second, and so on. The section also adjusts some misdemeanor-level and top-tier offenses in its own way.
How do prior felony convictions enhance a drug charge in Beaumont, TX?
Penal Code § 12.42 raises the range when the state proves prior felony convictions. With one prior, a third degree felony is punished as a second degree and a second degree as a first degree. A first degree felony carries 15 to 99 years or life. With two prior sequential felony convictions, a felony carries 25 to 99 years or life.
Does having a gun during a drug offense in Jefferson County change the charge?
A deadly weapon finding on a state jail felony makes it punishable as a third degree felony under Penal Code § 12.35(c). A deadly weapon finding also restricts community supervision granted by a judge and affects parole timing. Weapon possession can also be charged as its own offense, and federal law has firearm offenses tied to drug trafficking.
Does the state have to prove an enhancement in a Beaumont, TX drug case?
An enhancement is pleaded and proven like any other fact that raises the range. For a prior conviction, the state shows that the conviction exists, is final, and belongs to the accused. For a zone, it shows the location and the distance. Each of those facts can be contested at trial or at the punishment phase.
