Drug Diversion Lawyer In Beaumont, TX

Drug diversion means prescription medication leaving lawful channels through a forged script, a misleading statement to a prescriber, or theft from a workplace supply. Texas charges most of it as fraud under Health and Safety Code § 481.129, with the schedule of the drug driving the level. This page covers the statute, the penalties, the defenses and the licensing side.

What Is Drug Diversion In Texas?

Drug diversion is moving a controlled substance out of lawful channels, most often by prescription fraud. Texas Health and Safety Code § 481.129 makes it an offense to obtain a controlled substance or prescription through misrepresentation, fraud, forgery or deception, or by concealing a material fact. The schedule of the drug and the subsection charged set the level.

Understanding Texas Law

How Does Texas Law Define Drug Diversion And Prescription Fraud?

The main diversion statute is Health and Safety Code § 481.129. It makes it an offense to obtain or try to obtain a controlled substance, or a prescription for one, through misrepresentation, fraud, forgery, deception or subterfuge. It also reaches concealing a material fact from a practitioner, and it covers using a fraudulent prescription form or a false oral or electronic prescription.

A second group of provisions is aimed at people who hold a registration, such as practitioners and pharmacies, and distribute or dispense outside what that registration allows. Record-keeping failures by registrants are addressed in § 481.128.

Conduct that gets charged as diversion:

  • Changing the quantity, strength or refills on a real prescription
  • Phoning in or presenting a script the prescriber never wrote
  • Withholding an existing prescription from a second prescriber
  • Removing medication from clinic, hospital or pharmacy stock
  • Falsifying a waste or count record to hide a shortage

The last two can also be charged as theft or as drug possession, because medication taken that way was never prescribed to the person holding it.

Penalties And Consequences

What Are The Penalties For Drug Diversion In Texas?

Most drug charges are graded by penalty group and gram weight. Diversion works differently. The classification under § 481.129 turns on the schedule of the drug, and the exact subsection charged decides the range. The ranges below are statutory limits, not predictions.

How the level is set
By the schedule of the controlled substance and the subsection charged. Section 481.129 carries felony levels for the offenses it covers, and the schedule separates higher levels from lower ones.
Standard felony ranges
Third degree: 2 to 10 years. Second degree: 2 to 20 years. Fine up to $10,000 at either level.
Registrant offenses
Practitioners and pharmacies can face charges under separate subsections and record-keeping rules in § 481.128.
Licensing consequences
Handled by the relevant board in its own proceeding, which can run before, during or after the criminal case.
Federal law
21 U.S.C. § 843(a)(3) separately prohibits acquiring a controlled substance by misrepresentation, fraud, forgery, deception or subterfuge.

Schedule-by-schedule levels are not listed here. The subsection charged on the paper is the place to start.

Real Questions

What Do People Ask About Drug Diversion In Texas?

Is it a crime to take a prescription to a second doctor?

Not by itself. The offense arises when someone obtains or tries to obtain a controlled substance by misrepresentation or by hiding a material fact. For example, a patient who tells a new prescriber nothing about an existing prescription for the same drug may face questions about concealment. This is an example, not a real case.

Can a statement to my employer be used in the criminal case?

It can. What a person says to a supervisor, a human resources office or a board may be offered by the state. That is why the order in which each process begins matters.

What if the pills were prescribed to someone else?

Medication taken from a relative can be charged as possession, because it was never prescribed to the person holding it, and it can also raise a theft question. The drug's penalty group and weight then set the level.

Does a licensing board need a conviction to act?

No conviction is required for a board to open its own review. Each board follows its own procedures, so a criminal case and a board matter can overlap, and the board may look at the underlying conduct whatever happens in court.

Possible Defenses

How Can A Drug Diversion Charge Be Defended?

A workplace diversion file is often a set of records rather than a set of pills: cabinet access logs, override reports, waste witness entries and count discrepancies tied to a login. An attorney looks at what those records can and cannot show about one person. No result can be promised.

Prescription cases turn on intent. The state has to show a misrepresentation, a forgery or a concealed fact, and not an honest mistake or a miscommunication between offices.

Records have limits worth examining.

Shared credentials, unreliable timestamps, systems that were down, and counts done by other staff all affect what a data pattern proves about one person.

A resolution that avoids a conviction can matter later for expunction or nondisclosure, and for what a licensing board reviews.

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Drug Diversion Questions People In Beaumont Ask

Is a drug diversion charge the same as a pretrial diversion program in Beaumont, TX?

The two only share a word. Drug diversion is an offense: moving prescription controlled substances out of lawful channels by fraud, forgery or theft. Pretrial diversion is a way a case can be resolved, where prosecution is set aside while conditions are completed. Whether any such program is open for a given case in Jefferson County is a question for the prosecutor's office.

What law covers prescription fraud in Jefferson County?

Health and Safety Code § 481.129 covers obtaining or attempting to obtain a controlled substance or a prescription by misrepresentation, fraud, forgery, deception or concealing a material fact, and it covers using fraudulent prescription forms. Punishment is set in that section and depends on the schedule of the drug involved, so the name of the medication matters.

Is seeing several doctors a crime in Beaumont, TX?

Texas has no offense titled doctor shopping. Seeing more than one prescriber is not itself unlawful. The conduct becomes an offense under § 481.129 when a person obtains or tries to obtain a controlled substance or prescription by misrepresentation or by concealing a material fact, such as an existing prescription for the same drug.

Can a nurse or pharmacist in Beaumont face a licensing case over diversion?

Licensing boards such as the Texas Board of Nursing, the Texas State Board of Pharmacy and the Texas Medical Board run their own disciplinary processes, apart from the criminal court. A board can look at the underlying conduct whether or not there is a conviction. Each board has its own procedures, timelines and available monitoring or assistance programs.

How does prescription diversion get discovered in Jefferson County?

Texas keeps a prescription monitoring program that records dispensed controlled substance prescriptions, and prescribers and pharmacists must check it before issuing certain drug classes, subject to exceptions. In workplaces, automated dispensing cabinet logs, waste records and inventory counts are common sources of the discrepancies that start an investigation.
