Law License DWI Lawyer In Beaumont, TX
Texas lawyers and bar applicants sit under the Supreme Court of Texas, not a state agency, so a DWI is measured against disciplinary and admission rules that work differently from other licenses. This page covers those rules, the penalties and the first steps.
How Does A DWI Affect A Texas Law License?
Texas lawyers are governed by the Texas Disciplinary Rules of Professional Conduct. Rule 8.04(a)(2) bars a serious crime or another criminal act that reflects adversely on fitness as a lawyer. A misdemeanor DWI is not a serious crime as the rules define it, but fitness can still be questioned. Bar applicants answer to the Board of Law Examiners.

Understanding Texas Law
How Do The Disciplinary Rules Reach A Lawyer's DWI?
The Supreme Court of Texas holds authority over law licenses. Membership is run by the State Bar, grievances go to the Office of Chief Disciplinary Counsel under the Rules of Disciplinary Procedure, and the conduct standard is the Disciplinary Rules of Professional Conduct.
The rule that reaches criminal conduct is 8.04(a)(2). A lawyer may not commit a serious crime, or commit any other criminal act that reflects adversely on honesty, trustworthiness or fitness as a lawyer in other respects.
A misdemeanor DWI is not a serious crime as the rules define it. The live question under 8.04(a)(2) is the second clause, whether the act reflects adversely on fitness. That turns on facts, and a single arrest reads differently from a pattern, an injury crash or conduct at the scene.
What counts as a serious crime under the rules:
- Barratry
- A felony with moral turpitude as an element
- A theft, embezzlement or misappropriation misdemeanor
- An attempt, conspiracy or solicitation to commit any of these
Compulsory discipline attaches to a conviction or probation for a serious or intentional crime. A felony DWI, such as a third DWI, is measured against that definition's moral turpitude element, not the felony label alone.
The framework for other licenses is on the licensed professionals page, though much of it does not apply here.

Penalties And Consequences
What Are The Consequences Of A DWI For A Texas Lawyer?
The criminal range is the same for a lawyer as for anyone else. Chapter 53 of the Occupations Code, the general statute on criminal history and licensing, does not apply to licenses issued under the authority of the Supreme Court of Texas, so the court's own rules govern lawyers and bar applicants. These are rule texts, not predictions.

Possible Defenses
How Can A Lawyer's DWI Case Be Defended?
Whatever the criminal court records becomes the file that the bar, the board and employers read later. An attorney tests the stop, the testing and the paperwork, and also looks ahead to how each possible ending would read to a licensing reviewer. No result can be promised.
The TLAP route sits apart from discipline. The program serves lawyers, judges and law students with substance use and mental health concerns, and its communications are confidential. An order of nondisclosure is a different matter, because § 411.0765 of the Government Code names who may still receive sealed records.
A bar applicant's file is built from disclosures.
The Texas Board of Law Examiners assesses character and fitness from the filings and its own investigation. Its rules define chemical dependency and allow the board, if it finds an applicant may have one, to require an evaluation by a professional it designates.
An arrest between filing the declaration and sitting for the exam is exactly the kind of change the amendment duty covers. The ALR hearing before the State Office of Administrative Hearings must be requested within 15 days after notice, lawyer or not.

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
Law License DWI Questions People In Beaumont Ask
Can a Texas lawyer be disciplined over a DWI in Beaumont, TX?
Texas Disciplinary Rule of Professional Conduct 8.04(a)(2) bars a lawyer from committing a serious crime or any other criminal act that reflects adversely on the lawyer's honesty, trustworthiness or fitness as a lawyer in other respects. Whether a given DWI falls within that second clause is for the disciplinary system to decide on the facts.
Is a misdemeanor DWI in Beaumont, TX a serious crime under the Texas disciplinary rules?
The rules define a serious crime as barratry, a felony involving moral turpitude, a misdemeanor involving theft, embezzlement or fraudulent or reckless misappropriation of money or property, and attempts, conspiracies or solicitations to commit those. Compulsory discipline attaches to a conviction or probation for a serious or intentional crime. A misdemeanor DWI is not on that list.
Must a DWI in Jefferson County be disclosed to the Texas Board of Law Examiners?
The Declaration of Intention to Study Law and the bar application ask about criminal history, and a pending declaration must be amended with new or changed information. The board investigates character and fitness from those filings, and it can require a chemical dependency evaluation if it finds an applicant may have a chemical dependency.
Are communications with TLAP confidential for a lawyer in Jefferson County?
Communications with the Texas Lawyers' Assistance Program are confidential under Chapter 467 of the Health and Safety Code. The program states that it does not share information from a lawyer, law student or judge with the State Bar, the Board of Law Examiners or disciplinary counsel, subject to narrow exceptions set by law.
Does a nondisclosure order keep a Beaumont DWI from the State Bar?
Government Code § 411.0765 lists entities that can still receive criminal history covered by a nondisclosure order, and the list includes bodies connected to legal licensing. The order limits public access to the record. Whether a particular agency may still obtain it is answered by the text of that section.
