Scales of justice and a gavel resting on law books, representing the legal questions in a hemp THC DWI

DWI On THC, Delta-8, Or CBD Lawyer In Beaumont, TX

Hemp gummies, vapes, delta-8 cartridges and CBD oils are sold openly across Texas. A DWI after using one is charged under the same statute as any other, and the state still has to prove impairment.

A hemp product does not pause the license clock. Any DWI arrest can start an ALR license case. A hearing request is due within 15 days after you receive the notice of suspension, and the suspension begins on day 40 without one.

Can You Get A DWI From Delta-8 Or CBD In Texas?

Yes, if the state can prove the product left the driver without the normal use of mental or physical faculties. Penal Code § 49.01(2) covers any drug or substance, so legal status does not decide the charge. A hemp or CBD product is treated like any other substance, and impairment is what the state must prove.

Understanding Texas Law

How Does Texas Law Treat A DWI On THC, Delta-8 Or CBD?

A DWI after a hemp product is an ordinary Texas DWI under Penal Code § 49.04. The statute does not ask whether the product was lawful to sell. It asks whether the driver lost the normal use of mental or physical faculties because of a substance in the body.

Section 49.01(2) ends its list with "any other substance." A smoke shop gummy or a gas station vape fits that phrase the same way a prescription or a controlled substance does.

The Hemp Framework

Texas built its hemp program in 2019 with House Bill 1325. Hemp is defined by a delta-9 THC concentration of no more than 0.3 percent by dry weight, and it was removed from the definition of marihuana in the Controlled Substances Act. Growing falls under the Agriculture Code, and consumable hemp products under Health and Safety Code chapter 443.

That framework controls what can be grown, sold and held. It does not create an exception to the DWI statute.

Products that appear in these cases:

  • Hemp-derived delta-9 gummies and drinks
  • Delta-8 vapes, cartridges and edibles
  • Other hemp-derived cannabinoid products
  • CBD oils and tinctures that may carry some THC

Delta-8 in particular has been argued in the Texas courts, and the state hemp rules have been revised repeatedly. A product's status on the date of an arrest is a separate question from the DWI, and it matters most when a possession charge is added.

Penalties And Consequences

$2,000
Maximum fine, first offense
0.3 percent

Jail
72 hours to 180 days on a first offense.

Up to $2,000 on a first offense.
Product in the vehicle

Driver's license
An administrative suspension through ALR, apart from the criminal case, plus a possible suspension after a conviction.

Real Questions

What Do People Ask About A Hemp THC DWI In Texas?

Does a lawful purchase protect me from a DWI charge?

It does not. A receipt shows the product was sold, not that it was safe to drive on. The DWI statute is about the driver's condition. A lawful product can still support a charge if the state shows the driver lost the normal use of faculties.

Does a positive THC result prove impairment?

It proves THC was present, not that the person was impaired when driving. Active THC can leave the blood quickly while a metabolite can remain. Picture a driver whose report lists only a metabolite from a gummy eaten the day before. The link to impairment at the wheel would still be the state's burden. This is an example, not a real case.

Can the product itself become evidence?

It can. Labels on hemp products are not always accurate, so a driver who took something marked CBD only may have taken a product with THC in it. What the package said and what it actually held can both matter.

Does delta-8 show up on a standard blood panel?

Whether it appears depends on what the lab screened for and the method it used. Delta-8 and delta-9 are different compounds, and a report that lists only a total THC figure may not distinguish them. The full lab file, not the summary, shows the method.

Possible Defenses

How Can A Hemp THC DWI Be Defended?

A blood test looks for named compounds. Delta-9 from hemp and delta-9 from marijuana are chemically identical, so no test can say which a driver used. Delta-8 is a different compound, and whether a report separates it from delta-9 turns on the method and the compounds the lab screened for.

Past that, a THC result carries the usual limits. A positive result is evidence of use, and the state still has to link it to impairment at the time of driving.

Questions examined in a hemp THC case:

  • Which compounds the lab tested for, and by what method
  • Whether the result shows active THC or only a metabolite
  • What the product was, what the label said and what it held
  • Whether the officer's observations fit cannabis impairment at all
  • How the blood was obtained and handled

Who Handles Your Case

The Texas Lawyer Who Speaks Science

Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.

What does that mean for you?

It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:

  • Analyze lab results and spot faulty science
  • Cross-examine forensic experts with precision
  • Break down complex chemical evidence in plain language for juries

This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.

Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions

Hemp THC And DWI Questions People In Beaumont Ask

Can a delta-8 gummy lead to a DWI charge in Beaumont, TX?

Penal Code § 49.01(2) covers loss of the normal use of mental or physical faculties from a drug, a controlled substance or any other substance. A hemp product falls within that wording whether or not the store could lawfully sell it. The state must prove the product caused impairment while the person was driving.

Can a CBD product alone support a DWI in Jefferson County?

Cannabidiol is not generally described as intoxicating. Some CBD products still hold a small amount of THC, and labels are not always accurate. If a blood test finds THC after CBD use, the result can enter a DWI case, and the questions turn to what the product contained and whether the driver was impaired.

Can a lab tell hemp THC apart from marijuana THC in Beaumont, TX?

Delta-9 THC from hemp and delta-9 THC from marijuana are the same molecule, so a delta-9 result does not name the source. Whether a report separates delta-8 from delta-9 depends on the method the lab used, which is described in the full laboratory file and not in a one page summary.

Is delta-8 legal in Beaumont, TX right now?

Its status has been fought over in court and by state agencies, including in Texas Department of State Health Services v. Sky Marketing Corp. before the Supreme Court of Texas, and the hemp rules have been revised more than once. A DWI turns on impairment, so the answer does not decide the case.

What is the punishment for a hemp THC DWI in Jefferson County?

A DWI involving a hemp product is charged under Penal Code § 49.04 with the same range as any DWI. A first offense is a Class B misdemeanor with 72 hours to 180 days in jail and a fine up to $2,000. One earlier conviction makes it Class A, and two make it a third degree felony.

Does a low THC medical card change a DWI case in Beaumont, TX?

A card or a prescription does not create an exception to the DWI statute, since the state still has to prove lost normal use of faculties. Medical use can be part of the facts, including the dose, the timing and a patient's tolerance, and those details can matter to how the evidence is read.
