ALR Hearing Lawyer In Beaumont, TX
An ALR hearing is how a driver contests the automatic license suspension that follows a DWI arrest in Texas when a breath or blood test was failed or refused. It has its own judge, its own issues and a deadline that closes long before the criminal case gets going.
What Is An ALR Hearing In Texas?
An ALR hearing is a civil proceeding before a State Office of Administrative Hearings judge on whether the Texas Department of Public Safety may suspend a driver's license after a DWI arrest with a failed or refused test. Transportation Code chapters 524 and 724 govern it. A request is due within 15 days after the notice of suspension is received, or the suspension starts on day 40.

Understanding Texas Law
How Does An ALR Hearing Work In Texas?
ALR stands for administrative license revocation. It is a civil proceeding about one question: may the Texas Department of Public Safety suspend this driver's license? Transportation Code chapter 524 governs the case when a test showed 0.08 or higher, and chapter 724 governs it when the driver refused to give a specimen.
The criminal court never hears it. An administrative law judge from the State Office of Administrative Hearings presides, held by telephone or videoconference, and a DPS representative presents the department's side. Whatever is pending in Jefferson County has no say in the result.
Nothing has to be filed for the suspension to happen. The officer serves the notice at arrest after a failed breath test or a refusal, and the suspension follows unless a hearing is requested.
A blood draw works differently. The lab result can take weeks, so the notice may come by mail. Under the statute a mailed notice counts as received on the fifth day after mailing, and DPS tells drivers who agreed to blood testing that they have 20 days from the mailing date.
What DPS has to show after a test of 0.08 or higher (§ 524.035):
- Reasonable suspicion for the stop, or probable cause for the arrest
- An alcohol concentration of 0.08 or more while operating a motor vehicle in a public place, or a watercraft
- For a driver under 21, any detectable alcohol while operating
What DPS has to show after a refusal (§ 724.042):
- Reasonable suspicion or probable cause for the stop
- Probable cause that the person was operating while intoxicated
- An arrest, a request for a specimen and a refusal
The burden is a preponderance of the evidence. That is lower than the proof beyond a reasonable doubt a criminal conviction requires.

Penalties And Consequences
How Long Is A License Suspended After A DWI Arrest In Texas?
A timely request holds the clock. Without one, the suspension begins on day 40 even if the criminal charge is later dismissed or never filed. The lengths below are what the statutes set, not a forecast for any one driver.
Counted from the fifth day after mailing when the notice comes by mail.
Counted from receipt of the notice, or the day it is treated as received.
One year with a prior alcohol or drug contact in ten years.
Two years with the same kind of prior contact.
- Test result of 0.08 or higher
- 90 days. One year if the driving record shows an alcohol or drug enforcement contact in the previous ten years (§ 524.022).
- Refusal of breath or blood
- 180 days. Two years with such a prior contact (§ 724.035).
- Deadline to request a hearing
- 15 days from receipt of the notice of suspension (§ 524.031).
- If no hearing is requested
- The suspension begins on day 40, and the statute does not allow it to be probated (§ 524.021).
- Effect of a timely request
- The suspension is stayed until the judge's final decision (§ 524.032).
- Who hears it
- An administrative law judge of the State Office of Administrative Hearings, with the hearing recorded (§ 524.033).
- Who brings the case
- The Texas Department of Public Safety.
- Review of the judge's decision
- A petition for review in court, filed within 30 days after the decision becomes final (§ 524.041).
A hearing cannot be held earlier than the 11th day after the driver is notified of the setting unless both sides agree, and DPS tells drivers to allow up to 60 days for scheduling. If the request was timely, the suspension stays on hold the whole time.

Possible Defenses
How Is An ALR Hearing Contested?
DPS carries the burden on every issue, and the issues are narrow. An attorney reads the officer's sworn report, the notice, the test record and any video to see whether DPS can prove each one. If the judge does not find all of them in DPS's favor, the license is reinstated.
The statute also sets a floor. A judge may not find that a driver was at 0.08 or more if the analysis of the breath or blood specimen showed a lower number when it was taken (§ 524.035).
The record is built from paper and live testimony.
DPS leans on the officer's report and the test result. A driver can apply for a subpoena to bring in the arresting officer or the breath test operator, with a showing of good cause made ahead of the hearing date (§ 524.039).
An ALR hearing is often the first time the arresting officer answers questions under oath about the stop. That testimony is recorded, and a transcript can be set beside the officer's later account in the criminal case. The issues overlap with a motion to suppress there.
The Stop
What did the officer see that justified pulling the car over or starting the contact?
The Arrest
What facts supported probable cause that the person was driving while intoxicated?
The Warning
Was the statutory warning given in speech and in writing before a specimen was requested?
The Request
Was a specimen actually requested, and how was the answer recorded?
The Instrument
Do the maintenance and calibration records back the breath result on the report?
The Count
Was the request filed on time, measured from the correct date of receipt?

An occupational license can restore limited driving. The court order fixes the hours and purposes, and driving is capped at four hours in any 24, which can extend to 12 on a showing of necessity (§ 521.248). A commercial license is a separate matter, because the disqualification under § 522.081 is not lifted by an occupational license. The commercial vehicle DWI and underage DUI pages cover drivers who face different rules.
Next Steps
What Should You Do After A DWI Arrest To Protect Your License?
The deadline starts on its own, so the first days matter. These steps are general information, not advice for any one person.
Find The Notice
Locate the notice of suspension and the date you received it. If you are waiting on a blood result, note the day you were released.
Count The Days
Count 15 days from receipt. For a mailed notice, start from the fifth day after mailing, or use the 20 day rule DPS describes.
Gather Your Details
Collect the arrest date, the agency and officer, your license number and your contact information, which DPS asks for in a request.
Keep Every Paper
Save the notice, the bond papers, any test paperwork and the property receipt from the jail.
Ask About Driving
Ask what driving is possible during a suspension, including an occupational license for non-commercial use.
Mind A Commercial License
A commercial driver faces a separate disqualification that an occupational license does not lift.

Who Handles Your Case
The Texas Lawyer Who Speaks Science
Attorney Brennon Mitchell isn't just a seasoned Beaumont trial lawyer. He's one of the few in Texas, and the entire country, to earn the prestigious title of an ACS-CHAL Forensic Lawyer-Scientist. That means he's gone beyond the courtroom and into the laboratory, receiving in-depth, hands-on training in forensic chromatography, the same kind of testing used by crime labs to try and convict Texans every day.
What does that mean for you?
It means when the state uses blood alcohol or drug testing to try to prove its case, Mr. Mitchell knows how to challenge it. He's trained to:
- Analyze lab results and spot faulty science
- Cross-examine forensic experts with precision
- Break down complex chemical evidence in plain language for juries
This is not the kind of background you find in most criminal defense attorneys, and it could make the difference between a conviction and a clean slate.
Brennon graduated from Texas A&M University School of Law and practices from offices in Orange and Conroe.

Common Questions
ALR Hearing Questions People In Beaumont Ask
How is an ALR hearing requested after a DWI arrest in Beaumont, TX?
The request goes to the Texas Department of Public Safety within 15 days after the driver receives the notice of suspension. DPS then schedules the hearing before an administrative law judge at the State Office of Administrative Hearings. A request made in time keeps the suspension from starting on day 40 while the case is pending.
What does the judge decide at an ALR hearing for a Jefferson County arrest?
The administrative law judge decides whether DPS has proved its case by a preponderance of the evidence. After a failed test the issues are the basis for the stop or arrest and whether the alcohol concentration was 0.08 or more. After a refusal they include whether a specimen was requested and refused. The judge then sustains the suspension or orders the license reinstated.
How long is a license suspended after a DWI arrest in Beaumont, TX?
Under Transportation Code chapter 524, a failed breath or blood test carries a 90 day suspension, or one year when the driving record shows an alcohol or drug enforcement contact in the previous ten years. Under chapter 724, a refusal carries 180 days, or two years with a prior contact. These run apart from any suspension a court orders after a conviction.
Can a driver still get to work during a suspension after a Beaumont DWI arrest?
Texas allows an occupational driver's license under Transportation Code chapter 521, subchapter L. A court grants it by order, fixes the hours and purposes of driving and requires proof of insurance. The order cannot cover a commercial motor vehicle. When the court requires an ignition interlock device, the statute removes the waiting period that would otherwise apply.
What happens if the ALR deadline is missed after an arrest in Jefferson County?
DPS treats a late request as too late, and the suspension begins on the 40th day after the notice was received. The criminal case is not affected by the missed deadline and goes forward on its own schedule. An occupational license may still be possible for driving that does not involve a commercial vehicle.
Does the result of an ALR hearing decide the DWI charge in Beaumont, TX?
The two proceedings are independent. The administrative judge decides only whether the license is suspended, under a lower standard of proof than a criminal trial. The criminal charge continues in the county courts on its own schedule, and the result at the hearing, either way, does not decide guilt or innocence.
